PERMANENT UTILITIES AND ROAD SLOPE EASEMENT FOR CITY OF ASHLAND
,1. Grant of easement. The above named Grantor grants to the City of Ashland, Oregon,
"Grantee," a perpetual non-exclusive easement in gross to construct, reconstruct, install, use,
operate, inspect, repair, maintain and remove and replace public utility facilities including but not
limited to, lines for electricity, sewer, water, gas and telecommunications on reai property
described below and further referred to in this easement agreement as the "easement area" as
described on attached Exhibits A and B. ' .
Grantor further grants to the City of Ashland, Oregon, a perpetual non-exclushie right to extend
road cuts or fills across the real property described below and further referred tc)'in this .

2. Use of surface. Grantor shall have the right to use the easement area for all purpos~s not
inconsistent with the uses and purposes of the property, provided that Grantor shall not build or
place any structure upon the easement area without the prior written consent of Grantee.
3. Access to Easement Area. Grantee, its agents, independent contractors and invitees shall

have the right of ingress and egress to the easement area for the purposes connected with this
easement. ""
4. Notice. Grantee, its agents, independent contractors and invitees shall, upon every occasion
that such public utility facilities are constructed, maintained, replaced, reconstructed, or
removed, provide Grantor reasonable notice and restore the premises pf.the Grantor, and any
buildings or improvements disturbed by Grantee, as near as practicable"" .

5. Prior Encumbrances. This easement is granted subject to all prior easements or
encumbrances of record.

SLOPE AND UTILITY EASEMENT
A strip ofland, lying across that certain parcel described in Doq1lI1ent No. 96-29873,
~fficial Records, Jackson County, Oregon, and situated in the Northwest Quarter of
Section 5, Township 39 South, Range 1 East of the Willamette Base and Meridian, City
of AsWand, Jackson County, Oregon and being more particularly described as follows:
Commencing at the accepted Southwest corner of Donation Land Claim No. 38 of
said Township and Range; thence along the Westerly boundary line of said Claim, North
000 02' 36" East, 503.205 feet to a 5/8" iron pin on the Southerly right of way line of
Schofield Street; thence along said Southerly line, South 890 50' 43" East, 130.84 feet to a
.5/8" iron pin; thence 26.19 feet along the arc of a curve to the right, having a radius of
20.00 feet, a central angle of750 01' 23" and a long chord which bears South 520 20' 02"
East, 24.36 feet to a point on the Westerly right of way line of Monte Vista Street, being
