AN ORDINANCE DISPENSING WITH AN ELECTION WITHIN THE CITY OF
ASHLAND ON THE QUESTION OF A PROPOSED ANNEXATION AND SETTING
THE TIME AND. PLACE FOR A PUBLIC HEARING THEREON : SETTING A
PUBLIC HEARING DATE ON THE WITHDRAWAL OF CERTAIN REAL PROPERTY
FROM JACKSON COUNTY FIRE DISTRICT NO. 5 ; DIRECTING PUBLICATION
OF NOTICES AS DIRECTED BY ORS 222. 524: AND DECLARING AN
EMERGENCY. (KREBS ANNEXATION)
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS :
SECTION 1 . The City of Ashland finds that the owners of the prop-
erty escribed in Exhibit "A" attached hereto and by this reference
incorporated herein have consented to the annexation of said land
to the City of Ashland.
SECTION 2. The submitting of the question of the said annexation
is is ereTy—dispensed with and a Public Hearing is hereby called at
the Council Chambers , Civic Center, 1175 East Main Street , Ashland,
Oregon, on the 20th day of December, 1983 , at the hour of 7 :30 P.M. ,
at which time all persons may appear and be heard on the proposed
annexation.
SECTION 3 . The City Staff is directed to cause notice of said hear-
ing to'Fe given as required by ORS 222 . 120 so that public notices
are published in a newspaper of general circulation appearing in the
City in issues of such newspaper on December 6.th and Decemberl3th;3983 ,
and that notices be posted in four (4) public places in the City for
a period of not less than two (2) weeks prior to the date of the public
hearing.
SECTION 4. Pursuant to ORS 222 .524 a Public Hearing shall be held
on December "20 ;Z'983at 7 : 30 P.M. in the Council Chambers , Civic Center ,
1175 E. Main Street , Ashland, Oregon, on the question of the withdrawal
of certain real property from Jackson County Fire District No . 5 .
All persons may appear before the Ashland City Council and be heard on
the question. The real property above mentioned is situated in Jackson
County , Oregon and more particularly described in Exhibit "A" attached
hereto and by this reference made a part hereof .
SECTION 5. The City Staff is directed to publish and post notices of
sai earing in the same manner and on the same dates as described on
Exhibit "A" attached hereto relative to the . proposed annexation.
SECTION 6. It is hereby adjudged and declared that the existing con-
itions are such that this ordinance is necessary for the immediate
preservation of the public health and safety of the people of the City
of Ashland and an emergency is hereby declared to exist and this
ordinance shall take effect and be in full force and effect from and
after its passage and approval by the Mayor .

The foregoing ordinance was first read on the- ���` day of

A tract or parcel of land situated in Lot 33 of the Bellevue Tracts in the
Southeast quarter of Section 15, Township 39 South, Range 1 East of the
Willamette Base and Meridian, Jackson County, Oregon and being more fully
described as follows:
Commencing at a 5/8 x 30 inch iron pin with an aluminum cap situated at the
corner common to the Southeast corner of the Southwest quarter of the South-
east quarter of Section 15 and the Southwest corner of the Bellevue Tracts,
as now recorded; thence North 00 000'52" West along the North-South centerline
of the Southeast quarter of said Section 15 (deed record North) (plat record
North 0 009' East) and also being common to the Westerly boundary line of said
Bellevue Tracts, 712.76 feet to a 5/8 inch iron pin situated at the corner
common to Lots 32 and 33 of said Bellevue Tracts . for the True Point of
Beginning; thence leaving said North-South centerline, South 89 057'39"East
along the boundary line common to said Lots 32 and 33, (deed record East,
613.8 feet) 615.78 feet to a 5/8 inch iron pin situated in the Westerly
right of way of Park Street, as said right of way has been resurveyed and
shown on that Minor Land Partition filed for record the 19th .day of November,
1980 at 4:07 o' clock P.M. and recorded in Volume 3, page 77 of "Minor Land
Partitions in Jackson County, Oregon; thence North 00 014'44" East (plat
record North 0 009' East) along said right of way, 30.00 feet to a 5/8 inch
iron pin; thence leaving said right of way, North 89 057'39" West (deed record
West, 175.00 feet) and parallel to the boundary line common to said Lots 32
and 33 of the Bellevue Tracts, 175.00 feet to a 5/8 inch iron pin; thence
North 00°14'44" East (deed record North, 131 .36 feet) and parallel to Park
Street as herein set forth, 1.31 .36 feet to a 5/8 inch iron pin; thence
North 89 045' 16" West (deed record North 89°48' West, 203.0 feet) 203.00 feet
to a 5/8 inch iron pin; thence North 00°14'44" East (deed record North 0°12'
East, 86.87 feet) 88.20 feet to a 5/8 inch iron pin situated in the Southerly
right of way of the Talent Irrigation District Canal ; thence along said canal
right of way the following courses : thence South 52°25'55" West, 25.13 feet;
thence along the arc of a 60.00 foot radius curve to the right, the radial
bearings "in and out" are North 37 034'05" West and South 42°04'25" West (the
central angle is 79 degrees 38 minutes and 30 seconds) 83.40 feet; thence
North 47 055' 35" West, 56.20 feet; thence along the arc of a 190.00 foot radius
curve to the left, the radial bearings, "in and out" are South 42°04'25" West
and North 30 010'41 " East (the central angle is 11 degrees 53 minutes and 44
seconds) 39.445 feet; thence North 59 049' 19" West, 25.03 feet; thence along
the arc of a 410.00 foot radius curve to the left, the radial bearings "in and
out" are South 30 010'41" West and North 22°49'23" East (the central angle is
07 degrees 21 minutes and 18 seconds) 52.63 feet to a 5/8 inch iron pin situated
in that boundary line common to the West boundary of the Bellevue Tracts and the
North-South centerline of the Southeast quarter of Section 15, -said township
and range; thence South 00°00'52" East along said common boundary line (deed
record and plat record South 0 009' West) 334.75 feet to the point of beginning.
Containing 2.339 Acres, more or less.
Subject to any and/or easements and/or rights of way of record and those apparent
on the land.
