It is the right thing to do and a decision that is in the best interests of all of our citizens. It also has nothing to do with the proposed expansion.The arguments in the various blog's and letters, ranging from damage to the watershed, restoration, and financial stability are exactly why the permit belongs with the organization that raised the money and operates the Mountain. Residents of our town should not shoulder the liability that Mt Ashland and the Forest service share. Our City invested no money in the Mountain and was only a vehicle for the purchase. We also have a historical document with the Forest Service that makes them responsible for the watershed. It would seem to me that failure of the Ski Area should be the Ski area, then the Forest Service, not the citizens of Ashland. I would also like to address comments from the chairman of the Sierra Club. Your allegations that the Board would illegally cut the tree and the cost of expansion at 5 to 13 million are fear tactics at the best and not worthy ofyour leadership of a great organization. I am sure as a newly licensed attorney you realize that local volunteers on a nonprofit board would be personally liable for criminal acts. You are also aware that the Board has set 3.S million as the budget and it would be phased as donations are raised. This expansion may never actually happen without the support of our donors, but first we need to get approval from the Forest Service. Stoney Girl Gardens works with a third party group M-Scale to classify and clarify Medical Marijuana. The M-Scale is simple. It has a scale of numbers from 1-9; 1 meaning amphetamine and 9 meaning opiate. A number 5 is neutral. The scale also includes a periodic table of elements or effects such as M for Munchies, L for Long Duration of 3-4 hours and S for Short Duration of 0 -1 hours. This allows the doctor to tell his patient that they need a 3ml meaning something on the upper side that creates munchies and lasts for 3-4 hours. The patient can take this advice to the pharmacy and the pharmacy can determine stock. Experts all agree that MMJ will be as big, if not bigger than the American Industrial Revolution, and that it has already started! We believe this will save America and put us back to work. America was built on mom and pop businesses and it will take mom and pop to get us back on track; to provide employment and restore pride in workmanship. We were recently interviewed by Harvard Business Professors with PhD's whom all agreed that they knew of no other industry with such an immediate bright future. They look at years for recovery of other industries while this new industry will set new records. They fly across the country to get our outlook and prepare their forecasts and to meet the new players. In summary: • This will be Bigger than the American Industrial Revolution • It has Already Started! • Not Economy Driven • Creates Many Mom and Pop Businesses and Provides Employment • Puts America Back To Work and Creates New Tax Base! • Lowers Health Care Costs and Offsets Spending • Funds additional programs, ie: Education, Safety The Future Outlook of the Industry We need to make the transition from the Black Market to a Legitimate Industry. This is no longer a drug deal in the basement or alley way. We need to be up front, legitimate community involved citizens looking for permanent and acceptable solutions for the Medical Marijuana patient. We are working diligently for the Inclusion of Doctors and Scientists. We work with professionals who can only come up to the edge of marijuana but cannot touch or work with it. We need these professionals in our industry to give us the answers to questions we have had for ages. These professionals have assured us that they indeed can give us answers in milliseconds if only they were allowed to touch it. Until we have Federal acceptance, this will not happen and the patient is relegated to bathroom and garage science by non qualified individuals. 6 We want to be breeding by Science. As it stands we breed by phenotypes; things we can see, touch, taste, smell, and feel. If we had the science behind our work we could breed for targeting conditions instead of simply mixing phenotypes and using patients as testers. With cannabinoid profiles that describe why a particular strain removes headaches, and why another removes back pain, we could pinpoint conditions with our work. This new professional Industry will develop industry standards as needed. We look to associations and development of safe, secure, standardized methods of every facet. We look for full community acceptance and interface to include being involved in our Kiwanis Club, business associations, city councils, and other community events and organizations We look to Legislate, Regulate, and Tax this new industry with proceeds going to schools, safety and community needs. We need streamlined regulation that allows businesses to flourish with Clear Operating Rules. We need Safe Guidelines that must be developed by the industry So where does it go from here? Is it RJ Reynolds and Pfizer? MMJ is way too complicated to address with any one mega crop. Remember one size does not fit all and there are thousands of strains that affect thousands of conditions. We feel the industry will be much like the Tomato Industry. Almost all the tomatoes you buy at the store are produced by a small mom and pop farmer. The only tomatoes mass produced are those for ketchup or tomato soup. There are just too many varieties of tomatoes for,one mega farm to produce. Even after marijuana is fully legal world wide, Medical Marijuana will always be in the Medical Field and in a class of its own. Take a look at the chart below. There are already specialty upper scale spas, Credit Unions, Banks, Insurance Companies, Investment Brokers, Universities and more. There are credit unions you can only belong to if you're a medical marijuana card holder. There are Insurance companies who are insuring every aspect of mmj. There are investment firms ready to take your mmj business to an IPO. HR and Policy Makers have to make new policies that allow patients to medicate safely within the confines of extended care facilities. They can't just kick the patient out to the parking lot to get mugged for their stash. It is the responsibility of this care facility to provide a safe place for the patient to medicate. These policy makers are already understanding and making the changes here in Oregon. To create a solution we need to first analyze the true needs. Only then can we devise a solution to satisfy the need. In the MMJ industry, the subject matter has never merited qualified studies. Stoney Girl Gardens created an analysis for the State of Oregon in 2008 to show the amount of proposed revenues generated by the then dispensary bill. When completed the figures were extremely large and difficult to take. In the following illustrations note that there are many factors in place to show this study extremely conservative. 1. The amount consumed by the patient is 2 ounces per month which means less than a joint per day. We know of no patient who can survive on only one joint per day. Therefore if a patient uses 2 joints per day the entire figures double; 3 joints and the figure increase 3 times, and so on. 2. Patient population was figured at 20 percent when actual figures show 32 percent increase. This relates to over 750 thousand patients in the Oregon program by 2019, not the 150 thousand shown. Also remember that if the patient uses 2 joints per day the figures double; 3 joints the figures triple and so on. Also remember that the entire population of Oregon can fit inside a city like LA 5 times or Seattle so imagine what their needs are. Federal Prescriptions The Federal Government has been prescribing and producing medical marijuana for over 35 years. Elvie Musikka (Pictured Below) is an Oregon resident in Eugene and one of the last surviving medical marijuana federal patients in existence. She receives 300 pre-rolled joints in a canister every 25 days from the federal government. Last year when NIDA was asked as to the results of its 35 years of testing their reply was "Our mission is to find out the negative effects of Marijuana". This was the entire statement. It says that no negative effects have been found in 35 years of constant testing. Note however their mission was not to find the benefits. 11 Whatever the results, the patients in Oregon will consume over $36 billion in marijuana in the next 10 years. Let's make this safe through taxation and regulation rather than supporting the black market. It is a known fact that the average dispensary grosses 4-5 million per year in California. This is a lot of revenue that can be generated towards our future. Membership Based — Not Open to the Public All members are verified each visit to have proper ID, OMMP Card and Membership. Patient Grower Exchange Program — Patients may obtain their medicine from their grower. All exchanges are supervised through an agent of the Club to be verified for compliance and safety. Reimbursement — No Sales! Patients may reimburse their grower for expenses only. Each grower must validate and verify expenses, safety and other information for each exchange. All exchanges are documented. In summary the Club is a Membership Based Club that simply facilitates the Safe and Compliant exchange of Medical Marijuana between Patients and Growers. In addition we provide education, tools, supplies and development. This is a full solution club to enable the individual patient to be successful and work within the Oregon Medical Marijuana Program. Important Notes: No Medicating —There will be no medicating and no smoke parlors at the club. This removes any chance for the patient to leave under the influence. Type of Members — Baby Boomers and retirees are the base of our patients. DHS states that the average age of the patient is 57. These are the blue collar working folks of our community. There are many who may wish to remain private. All wish to not seek out drugs on the street. These people are your neighbors and coworkers. They are the ordinary citizen, not the dealer. Law Enforcement Interface — The club will work closely with law enforcement and city to ensure safe services and compliance. No Late Hours — Club operation hours are normally 12 noon to 6 pm. 14 Membership Application and Verification Process • The patient must have a verifiable OMMP ID Card and Photo ID. Oral or unverifiable recommendations are suspect and offer limited protection to the patient and club. • The patient must explicitly consent to affiliation (membership) in the club. This requires completing and signing a membership registration form. • The patient must have to obey the rules of the club to maintain membership. These rules shall be written and provided to the members when they join. • The patient must only be a member as long as he or she has an unexpired Oregon OMMP ID Card. Membership must renew annually whenever the member's OMMP Registration renews. Membership Rules • Violating local and state laws— Members may not violate local and state guidelines and regulations • Release of Liability- Member releases Club from any and all liability for medical or legal problems which may occur as a result of the use of medicinal cannabis supplied. • The presence of any weapons or illegal drugs— No guns, weapons or illegal drugs shall be allowed in the club. • Acquiring or providing medicine to anyone who is not a duly registered member. Members must not acquire medicine or provide medicine outside of the duly registered membership of the Club. Doing so violates state law and is grounds for revocation of membership. • Any inter-state activity acquisition or distribution of medicine. All medicine acquired and provided at the Club is grown by registered members who are legally entitled to do so inside the state of Oregon. No medicine can come from outside Oregon, and it is never legal to distribute medicine outside of the state. You must be an Oregon Registered Card Holder. • Conduct and Behavior- Shoplifting, dangerous/violent behavior, serious disorderly conduct, causing a nuisance in the neighborhood, or repeated willful violations of the rules are grounds for revocation. • Patients and Growers shall not exchange directly. All exchanges will be performed through the Authorized Agent of the Club. 15 Membership Records Membership records shall be in electronic database, spread sheet, and paper forms. Required Forms Each new prospective member shall fill out and sign a membership form stating that the member shall follow all rules of the club and include: Copy of Photo ID Copy of Oregon Medical Marijuana Card Release and Authorization Signature Recorded Transaction Records All transactions shall be recorded and all taxes due shall be paid. Transactions for patients shall be recorded and limits for amounts received shall be enforced to prevent diversion. No patient shall be allowed to receive amounts beyond those needed by the patient to ensure the intended medicine is only used by the patient and not otherwise diverted. All medicine not exchanged shall be returned to the grower and patient. The majority of patients cannot, should not, or will not smoke. At minimum Medical Marijuana is a food product. As such we instruct all our club employees to obtain an Oregon Food Handlers Card prior to working at the club. We teach our patients to use safe food production guidelines when preparing edibles. We require food grade packaging and handling, labeling to include contents, manufacturer and warnings, Dosage information is also required — Quantifiable and Qualified, listed on the label. Consistency quality and safety are all issues we address. Possession and Cultivation Guidelines As a requirement, all our clubs: • Only keep as much medicine as can be covered with available OMMP cards listed to that site through the State. • Never keep a large quantity on hand of medicine or cash. • Keep No Cash or Stash on site during off hours of operation Security and Public Safety Guidelines These guidelines are required to maintain adequate security to protect patients and the community. Safety for patients and the community must be a top priority at these facilities, so a compliant association will adopt a security culture to ensure safety. Security culture refers to a set of practices and strategies that work together to maintain safety. Security culture may involve the following elements: • Employing professional, trained security personnel • Staying alert to detect problems before they occur • Educating patients to be sure they know the rules • Implementing policies to prevent diversion • Restricting access to the facility to authorized persons • Using appropriate security technology and equipment to monitor and secure the facility during hours of operation and overnight • Maintaining communication with local law enforcement • Training staff to prevent and respond to emergencies 17 • Educating staff and members as to their rights and responsibilities under the law Health Care Costs The Oregon Medical Marijuana Program has had a huge impact on Health Care costs for the state of Oregon. It has been a major cost containment measure. • 10% Oregonians generate 69% Health Care Costs (Oregon Health Fund Board Report) • 9% population suffer from severe and chronic pain (American Pain Society) • Pain is the #1 Driver of Health Care Costs • Chronic Disease Management is the #2 Driver of Health Care Costs • Medical Marijuana addresses both and has been shown to drastically reduce costs Direct Savings • Emergency Room Care reduced and eliminated • Regular Doctor Visits reduced to annual visits • Prescription Drug Intake greatly reduced and eliminated • Improves Outcomes • Frees up Resources Political and Economical Climates • Multiple States Address Issue of MMJ.
