The parcel is roughly square in shape,with approximately 98 feet of frontage on Gresham Street and 104 feet of frontage along Iowa Street and an approximate area of 10,128 square feet. The parcel is relatively flat,with an average downward slope to the north of approximately nine percent, but the southern portion of the lot nearest to Iowa Street is more steeply sloped, with areas closest to the street having slopes in excess of 35 percent. The existing home is approximately 1,523 square feet and two-stories. With the current application the applicants propose to construct an addition on the north side of the home. Because the proposed addition will cast a shadow onto the property to the north greater than the shadow which would be cast by a six-foot fence on the property,a solar access variance is required. The application includes a shadow plan noting that the shadowing proposed extends only about 28-inches beyond the shadowing that would be allowed for a six-foot fence, and falls in an area at the southwest corner of the impacted property, behind the existing house. The application materials provided note that the addition will not preclude the reasonable use of solar energy on the site by future buildings, explaining that the addition is proposed on the north side of the subject property where solar energy is potentially already limited by the existing home's shadow. The applicants note that there is ample opportunity for solar energy on the south side of the existing home's main ridge and that the variance does not preclude use of solar energy on the site by future buildings. I The applicants explain that the habitable structure on the lot to the north is well to the east of the proposed shadow encroachment and is thus not impacted due to slope and vegetation conditions to the west that would naturally block solar access to the requesting property as well as to the agreeing property. The applicants suggest that the property owner to the north considers the proposed shading to be negligible to the current condition and inconsequential to future development of the site. PA#2010-00802 231 Gresham St/dds Page 1 The applicants conclude that the existing trees and vegetation,the hillside area to the west,and the existing development to the west preclude reasonable use of solar energy for the affected property already, and suggest that the proposed shading impacts the property in an area unlikely to accommodate future development or to pursue solar access due both to these constraints and to the established location of the home now on the site. The existing home, built in the Vernacular style with Queen Anne elements in approximately 1898, is designated the"Pennebaker-Barney House"or the"Kid's House"in the Siskiyou-Hargadine Historic District survey document. The survey notes that the house has a clipped gable volume with a projecting bay,entrant porch, and other detailing. The original horizontal wood siding,with shingles in the gable end,wide frieze bands,boxed soffits,windows and window trim all survive. The home was long used as a childcare center, and was thus somewhat modified in setting by the requirements of that use,but the inventory survey notes that the Pennebaker-Barney House retains sufficient integrity to relate its appearance during the period of historic significance and it is designated as a historic contributing resource within the Siskiyou-Hargadine District. The Historic Commission's review board reviewed the proposal and felt that the addition was well-designed and compatible with the existing home and surrounding district;they recommended that the proposal be approved as submitted. In reviewing the request,staff noted that while the existing lot is large enough to accommodate an addition elsewhere,the topography along Iowa Street at the south side of the existing home is quite steep,limiting the potential to build there. An large existing apple tree located to the northeast of the home limits development options there as well. However,for staff the most compelling considering is that the existing historic home is set well back from the street,and it's finished floor level is significantly above the ground level of the lot, likely in order to address a grade differential between the building site and the street to maintain a stronger presence of the building within the streetscape(rather than giving it the appearance of sitting in a hole). The placement of an addition elsewhere on the lot would likely significantly detract from the existing historic home's relationship to the street, and the addition proposed seems to respect and maintain the existing historic home's prominence. While the addition is limited to one-story to minimize impact to solar access, its height is somewhat dictated in having to respond to the finished floor elevation of the existing home. In staff s view, the design proposed achieves an excellent balance of respectfully addressing the historic contributing Pennebaker-Barney House's prominence within the streetscape,and has tried to minimize the height of the addition while keeping it compatible to the existing home and providing for a functional flow between the two spaces. The placement of the addition is dictated by the constraints of the property and the placement of the existing home,and we believe that the proposal's impacts to the solar access of the property to the north have been minimized to the degree possible while addressing these issues. The criteria for a Solar Access Variance are described in AMC Chapter 18.70.060, as follows: a. The variance does not preclude the reasonable use of solar energy on the site by future buildings; and b. The variance does not diminish any substantial solar access which benefits a habitable structure on an adjacent lot. i PA#2010-00802 231 Gresham St/dds Page 2 c. There are unique or unusual circumstances which apply to this site which do not typically apply elsewhere, The application with the attached conditions complies with all applicable City ordinances. Planning Action 2010-00802 is approved with the following conditions. Further,if any one or more of the following conditions are found to be invalid for any reason whatsoever,then Planning Action 2010-00802 is denied. The following are the conditions and they are attached to the approval: 1) That all proposals of the applicant shall be conditions of approval unless otherwise modified here. 2) That the additional shadowing approved here is limited to that illustrated in the applicants' Solar Access Waiver site plan dated July 8, 2010, The final submittals for building permit shall be in substantial conformance with the drawings submitted with the Solar Waiver application, and any additional shading proposed beyond that requested here would require modification of this approval and resubmission of a Solar Waiver application. Pennebaker, a lumber manufacturer, purchased the property. In 1910 the house was sold and the local newspaper noted that "H. A. Barney recently bought the Pennebaker place at the corner of Iowa and Gresham. He is completely remodeling the dwelling" (Ashland Tidings, 18-April-1910, 5:2). Barney, a carpenter, likely did the work himself. The house is documented by the County Assessor as being owned by Barney's wife, Lydia. (JCD 78:290) In 1920 E. M. Holmes owned the.property (JCD 120:426) and J. G. and Lena Grace Houck were its owners and occupants by 1948-1949 (JCD 286:511). Hatcher has cottage up on his lot in Reeser's Highland Park Addition" (Ashland Tidings, 14-December-1888, 3:1). Hatcher, a carpenter, likely built his family's home himself and in January of the following year the construction was reported as completed at a cost of$800 (Ashland Tidings, 4-January-1889). Hatcher, who also worked as an Ashland Street Commissioner and in 1921 served as Ashland's Chief of Police, retained ownership of this property for more than four decades, selling it 1931 to Edna Valjean (JCD 189:161). Sidney Gay, a millworker at the Talent Saw Mill, and his wife Gladys owned the property by 1942 and retained it at least through 1949 (JCD 176:174). We typically need elevation drawings of the proposed building,but I went ahead and pulled these from your building permit submittals. I need two things before I can call the application complete and finish processing it: 1)The original of the signed solar access waiver agreement. What we have in the file is a copy,and we need the original because we record it on the property deed and the county won't record a copy. 2)A revised site plan labeled"Exhibit B"for attachment to the agreement. This can be essentially your submittal minus topography and trees,BUT it needs to have the allowed shadow for a 6-foot fence shown and the proposed shadow for your addition beyond what would be cast for the 6-foot fence so that it is clear what additional shading beyond that allowed by ordinance is being agreed to. With recording,the agreement is for a specific area of shadow being allowed beyond that permitted by ordinance. I've attached a copy of our sample drawing with some notes to clarify what we need in red. I I'll prepare the necessary maps,notices and labels,but we'd need to have the above two items in the file before we can mail the notices. Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn Way,Ashland, Oregon 97520 prior to 4:30 p.m.on the deadline date shown above. Chapter 18.70.060 Solar Access Variance findings: a. The variance does not preclude the reasonable use of solar energy on the site by future buildings The addition occurs on the north end of the requesting property where solar energy is potentially blocked by the existing roof line of the existing structure. Given that there is ample opportunity for solar energy on the south side of the main existing ridge, the variance does not preclude reasonable use of solar energy on the site by future buildings. b. The variance does not diminish any substantial solar access which benefits j a habitable structure on an adjacent lot. The habitable structure is to the east of the affected shadow encroachment as is not affected by the encroachment due to steep hillside and tree conditions to the west that would naturally block solar access to the requesting property as well as the agreeing property. The property agreeing to the solar waiver considers the proposed encroachment negligible to the current condition and inconsequential to any future developments on the site. c. There are unique or unusual circumstances which apply to this site which do not typically apply elsewhere. As stated in item b. above, the existing trees and vegetation, the hillside to the west and the existing development to the west preclude reasonable use of solar energy on the existing residence to the north east of the proposed addition of the requesting property.
