COMPREHENSIVE PLAN DESIGNATION: Single Family Residential; ZONING: R-1-5; ASSESSOR'S MAP#: 39 lE 04 DC; TAX LOT: 1500 SUBMITTAL DATE: April 15, 2011 DEEMED COMPLETE DATE: April 20, 2011 STAFF APPROVAL DATE: May 9, 2011 APPEAL DEADLINE: May 21, 2011 FINAL DECISION DATE: May 22, 2011 APPROVAL EXPIRATION DATE: May 22, 2012 DECISION The subject property is a vacant lot located at the southwest corner of Patterson and Phelps Streets, is zoned R-1-5, single-family residential, and is approximately 9,150 square feet in size. A previous tree removal approval to was granted on July 30, 2009 to remove three White Poplar trees greater than 24 inches D.B.H. The trees were determined to be hazardous by a licensed arborist due to limb breakage and trunk rot. The subject tree is a 28 inch European White Poplar. Mr. Wangle, a licensed ISA arborist from Beaver Tree Service, stated that although the tree is in fair condition presently,the canopy is approximately 25 percent dead, and is prone to limb breakage. The tree's canopy also hangs over the adjacent lot to the south, and has been damaging the property owner's driveway. The neighbor also stated that he has been having problems with the roots encroaching into the crawl space underneath his home, and although measures have been taken to limit the trees growth, the roots continue to cause damage to his property. Mr. Wangle continues to say that regular maintenance may help reduce potential hazards; however with the owner residing out of state, the potential to injure persons or property is too great of a liability and cost, and will enviably continue to break limbs and cause damage to the adjacent property. The Tree Commission reviewed the application at their May 5, 2011 meeting. They concurred with the arborist's recommendation for removal and required mitigation as a condition of approval. Removal will not have a significant negative impact on erosion, soil stability, or existing windbreaks; nor a negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. In staff's opinion,the potential for damage due to breaking limbs is reason enough for the tree to be removed. Staff feels that over time, all of the trees have been removed from this vacant lot and is now void of trees. Staff recommends that the applicant mitigate removal by either planting more appropriate on this property,plant trees on another property in common ownership, or pay into the Tree Fund in lieu of planting. Therefore, staff believes that the tree removal request meets the criteria of the ordinance and is approved to be removed. PA#2011-00469 332 Patterson/MP Page 1 The criteria for a Tree Removal Permit are described in AMC Chapter 18.61.080, as follows: An applicant for a Tree Removal Permit shall demonstrate that the following criteria are satisfied. The StaffAdvisor may require an arborist's report to substantiate the criteria for a permit. B. Tree that is Not a Hazard: The City shall issue a tree removal permit for a tree that is not a hazard if the applicant demonstrates all of the following: 1. The tree is proposed for removal in order to permit the application to be consistent with other applicable Ashland Land Use Ordinance requirements and standards. (e.g. other applicable Site Design and Use Standards). The StaffAdvisor may require the building footprint of the development to be staked to allow for accurate verification of the permit application; and 2. Removal of the tree will not have a significant negative impact on erosion, soil stability,flow of surface waters,protection of adjacent trees, or existing windbreaks; and 3. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. The application with the attached conditions complies with all applicable City ordinances. Planning Action 2011-00469 is approved with the following conditions. Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2011- 000469 is denied. The Staff Advisor may require an arborist's report to substantiate the criteria for a permit. A. Hazard Tree:The Staff Advisor shall issue a tree removal permit for a hazard tree if the applicant demonstrates that a tree is a hazard and warrants removal. 1. A hazard tree is a tree that is physically damaged to the degree that it is clear that it is likely to fall and injure persons or property. A hazard tree may also include a tree that is located within public rights of way and is causing damage to existing public or private facilities or services and such facilities or services cannot be relocated or the damage alleviated. The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard or a foreseeable danger of property damage to an existing structure and such hazard or danger cannot reasonably be alleviated by treatment or pruning. 2. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to AMC 18.61.084. Such mitigation requirements shall be a condition of approval of the permit. B. Tree that is Not a Hazard: The City shall issue a tree removal permit for a tree that is not a hazard if the applicant demonstrates all of the following: 1. The tree is proposed for removal in order to permit the application to be consistent with other applicable Ashland Land Use Ordinance requirements and standards, including but not limited to applicable Site Design and Use Standards and Physical and Environmental Constraints. Removal of the tree will not have a significant negative impact on the tree densities,sizes,canopies, and species diversity within 200 feet of the subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone. Nothing in this section shall require that the residential density be reduced below the permitted density allowed by the zone. In making this determination,the City may consider alternative site plans or placement of structures or alternate landscaping designs that would lessen the impact on trees,so long as the alternatives continue to comply with other provisions of the Ashland Land Use Ordinance. 4. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to AMC 18.61.084.Such mitigation requirements shall be a condition of approval of the permit. Diameter at breast height: 28 inches; heigjit: approximately 45 feet. Evaluation: The tree in fair condition. There is no visible rot on the trunk There were no signs of root rot, eg mushrooms, on the day of evaluation. However,the canopy is perhaps 20-25% dead, including some larger limb-,. Some limbs have broken and hang down. These dead limbs pose a hazard for two reasons. Firstly, the tree is located in an empty lot in a neighborhood and thus likely receives its share of uncontrolled traffic. Secondly, limbs hang over the fence and back driveway at the side of the neighboring house at 499 Phelps Street. Although the entire tree may live for some time, limbs will continue to die back, creating a maintenance expense and posing a continued hazard. The root system of the tree is also causing problems for 499 Phelps. The older concrete in the front drive is severely cnacka One broken section has been raised more than an inch above grade and, according to the owner, this has happened within the last year. The new concrete in back is already cracking despite the filet that it is only a few years old and that the property owner trenched between the tree and the concrete in order to limit root damage. Poplar shoots were clearly visible along the edge of the back concrete at time of evaluation. In addition the owner explained that he has to clean roots out the crawl space to keep it accessible. Recommendations.- I recorninend removing the tree. White poplars are always a problematic residential tree. They break frequently, grow fast and cause damage to nearby hardscape. Regular maintenance can reduce the potential ha7md of the tree,but it cannot prevent damage to concrete and foundations.
