Oregon
Dear Owner and/or Occupant,
Your building at the above referenced address (the "Property") is in violation of the Ashland's
Municipal Building Code, is unsafe and you are ordered to vacate it immediately within 36 hours from
the date of its posting on, August 31St, 2011, /,O Arr-t (time). 2003 International Existing Building
Code (IEBC) Sec. 115-116 et sec; Ashland Municipal Code (AMC) 15.04.010.
As the Building Official to the City of Ashland, I have caused the Property to be inspected. As a result
of my department's investigations I deem the building unsafe for the following reasons:
• The attic area is unfinished, has not been inspected for electrical or plumbing service, and
therefore not suitable as a living space, nor is the property zoned for residential use as it is
presently being used.

In order to restore or repair the Property to a safe and habitable condition you are Ordered to:
• Vacate the Property within 36 hours of the above stated day,and time of posting.
• Submit for new land-use action and obtain appropriate building permits
Other than vacating the Premises, any other actions you make in compliances with the above conditions
must be approved by my office, and a Certificate of Occupancy is duly issued for the Property before
you may again occupy the Property.
A report supporting the above reasons and conditions to restore or repair the Property is filed with
Jackson County Records and is available at my office. You are required to declare immediately
(within 36 hours of the above stated date and time of posting) to my office your acceptance or
rejection of the terms of this Order. You are afforded an opportunity for a hearing to appeal this
Order as provided below. In the meantime, you will comply with this Order. Your failure to do so is
further violation under IEBC Sec 113 and AMC 15.04.260. Furthermore, my office will be seeking all
appropriate measures and proceedings at law to enforce this Order, including but not limited to
disconnecting service utilities (IEBC Sec 111), and your immediate eviction (ORS 105.105 et sec).
This notice also serves as a Notice and Order Imposing the Civil Penalty for violation of AMC
15.04.260, Failure to obey Unsafe Posting of this building on March 24dh, 2011; Failure to obtain
appropriate building permits. The city intends to seek a civil penalty of$500.00, or that does not
otherwise exceed the maximum civil penalty amount authorized for an equivalent specialty code
violation under ORS 455.895.
Right To Appeal: Concerning both the above Order to vacate and Order imposing a civil penalty, you
have 15 days within the above stated date and time of posting to file an appeal. AMC 15.04.200 and
250-260.

Restoration Report for the "Notice of Unsafe Building and Order to Vacate"
In order to restore and repair the above mentioned property the owner must, (in
accordance with Ashland Municipal Code, chapter 15):
• Make a new application for a New Site Review Approval
• Submit a new set of plans for the remodel of the building.
• Obtain a Land Use permit
• Gain approval from Historic Review Board
• Pay appropriate fees associated with the application and permit.
• Obtain construction permits.
• Uncover all work for inspection
• Make all necessary corrections using licensed sub contractors
• Call for inspections for all phases of construction
• Obtain a Certificate of Occupancy when final inspections are complete
