Good afternoon. I have yet to hear back from you on choosing a licensed, certified arborist to supervise the
trenching work. I would like to remind you that this was a condition of approval for your Site Review as follows:
3) That the applicants have a licensed, certified arborist on-site to supervise trenching within the landscape
medians to help ensure the trees survival through construction; and the applicant shall provide the Planning Division
the name of the certified arborist who will be on-site prior to trenching work begins.
Because this was a condition of approval, we cannot issue the permit until all the conditions are met.Thank you.

DECISION
The subject property is located at the terminus of YMCA Way, north of Ashland Street, west of Tolman
Creek Road. The property is zoned C-1, approximately three acres in size, and is home to a large athletic
facility and associated uses and structures. The applicant has been approved for multiple additions over
the years, most recently a 2-story addition that brought the building in conformance with the City of
Ashland's Site Design and Use Standards in 2001 (PA-2001-058).
The applicant is proposing to construct a 144 square foot mechanical "pump house"for a 20,000 gallon
underground water tank that will serve the YMCA. The pump house will be p laced adjacent to the
Tolman Creek right-of-way, within the large landscape median that separates the YMCA's tax lot with
the Parks parcel directly to the north. The application also includes installing new water and electrical
lines through the landscaped areas to serve the water tank, and a tree removal permit to remove a multi-
trunk Elm that is planted where the proposed pump house will be located. Ashland Municipal Code
(AMC) 18.72.030.A.a states that all new structures, additions, or expansions in the C-1 zones are subject
to Site Review. j
The proposed pump house will be a small 144 square foot outbuilding with a ramp and bollards facing
the parking lot immediately to the south. The structure will be placed on a concrete foundation, be
approximately 14 feet tall, and will be comprised of split-block CMU and lap siding painted to match
the existing YMCA building. The roof will be a standing seam metal roof, also matching the YMCA
roof. A single light will be installed above the door. Although the property is located entirely within a
Commercial zone, staff will add a condition to have the light shine downward and not onto neighboring
properties.
One criteria of approval for Site Review is that the building has an orientation to the street with
windows, architectural details, and pedestrian amenities. However, staff felt as though having an

orientation to Tolman Creek would be counter to the intended use of the structure, which will house
mechanical equipment, and would not be accessed by the public. As such,the applicant will provide
screening on the east side of the structure, adjacent to the Tolman Creek right-of-way, so that it would
not be easily seen from the street. The applicant is proposing to plant three Compact Austrian Black
Pines immediately east of the pump house to screen the building from the street. The plantings will grow
approximately 15 feet tall, and 8 to 10 feet wide. The applicant will also add additional plantings to the
site in areas that may be negatively affected by the work.
The applicant has also requested a Tree Removal permit for the multi-trunk Elm planted in the location
of the proposed pump house. The tree is not considered hazardous, and removal will not have a
detrimental effect on existing diversity and canopies in the area. The Tree Commission at their July 7 1
meeting discussed the tree removal and trenching work to be done within the landscape medians. They
stated that the tree removal is okay,but had concerns regarding the trenching work conducted within the
root zones of the 12 trees affected by installation of the new water and electrical lines.
Section 18.61.200 of the Ashland Municipal Code requires a Tree Protection Plan to be submitted with
application materials when work is done in close proximity to trees. Protection measures include
protection fencing be installed along the drip line of nearby trees, no construction activity or storage of
equipment be within protection zones, and that no excavation or trenching shall occur within the tree
protection zone unless approved by the staff advisor. Due to the physical work within the tree protection .
zones,protection fencing is not feasible within the scope of the project and will not be required.
However, although staff understands the unique nature of the proposal, and that trenching in an
inevitable piece of the project, we also recognize the important role that trees play in our community.
The presence of trees not only enhances the physical character and beauty of a place, but also has greater
implications for our community as a whole; such as health, safety, providing wildlife habitats, and
physiological benefits as well. The current landscaping was planted in 1989 with the original Site
Review approval, therefore has been established for more than 20 years.
The application materials stated that the trenching will be placed as close to the curb line as possible,
however the application did not indicate how the trenching will be performed, and what measures will
be taken to preserve the existing trees. Staff shares the Commission's concerns and felt that it would be
appropriate to have a licensed, certified arborist on-site to supervise the trenching through the
landscaped areas to help ensure the trees survival through construction. In addition, the Tree
Commission asked that all construction materials and equipment be placed within the existing parking
areas and not underneath tree canopies. A condition of approval will be added to the permit stating these
recommendations.

Due to the small scale of the building, and the intended use to house mechanical equipment, staff
believes that the applicant's proposal meets the requirements for Basic and Detail Site Review.

The criteria for Site Review Approval are described in AMC Chapter 18.72.070, as follows:
A. All applicable City ordinances have been met or will be met by the proposed development.
B. All requirements of the Site Review Chapter have been met or will be met.
C. The development complies with the Site Design.Standards adopted by the City Council for
implementation of this Chapter.

D. That adequate capacity of City facilities for water, sewer,paved access to and through the
development, electricity, urban storm drainage, and adequate transportation can and will be
provided to and through the subject property.
The criteria for a Tree Removal as described in AMC Chapter 18.61.080, as follows:
A. Hazard Tree: The Staff Advisor shall issue a tree removal permit for a hazard tree if the
applicant demonstrates that a tree is a hazard and warrants removal.
1. A hazard tree is a tree that is physically damaged to the degree that it is clear that it is likely
to fall and injure persons or property. A hazard tree may also include a tree that is located
within public rights of way and is causing damage to existing public or private facilities or
services and such facilities or services cannot be relocated or the damage alleviated. The
applicant must demonstrate that the condition or location of the tree presents a clear public
safety hazard or a foreseeable danger of property damage to an existing structure and such
hazard or danger cannot reasonably be alleviated by treatment or pruning.
2. The City may require the applicant to mitigate for the removal of each hazard tree pursuant
to AMC 18.61.084. Such mitigation requirements shall be a condition of approval of the
permit.
B. Tree that is Not a Hazard.- The City shall issue a tree removal permit for a tree that is not a
hazard if the applicant demonstrates all of the following:
1. The tree is proposed for removal in order to permit the application to be consistent with
other applicable Ashland Land Use Ordinance requirements and standards, including but
not limited to applicable Site Design and Use Standards and Physical and Environmental
Constraints. The Staff Advisor may require the building footprint of the development to be
staked to allow for accurate verification of the permit application; and
2. Removal of the tree will not have a significant negative impact on erosion, soil stability,flow
of surface waters,protection of adjacent trees, or existing windbreaks; and
3. Removal of the tree will not have a significant negative impact on the tree densities, sizes,
canopies, and species diversity within 200 feet of the subject property. The City shall grant
an exception to this criterion when alternatives to the tree removal have been considered and
no reasonable alternative exists to allow the property to be used as permitted in the zone.
Nothing in this section shall require that the residential density be reduced below the
permitted density allowed by the zone. In making this determination, the City may consider
alternative site plans or placement of structures or alternate landscaping designs that would
lessen the impact on trees, so long as the alternatives continue to comply with other
provisions of the Ashland Land Use Ordinance,
4. The City shall require the applicant to mitigate for the removal of each tree granted approval
pursuant to AMC 18.61.084. Such mitigation requirements shall be a condition of approval
of the permit. (ORD 2951, 2008; ORD 2883, 2002)
The application with the attached conditions complies with all applicable City ordinances.
Planning Action 2010-01244 is approved with the following conditions. Further, if any one or more of
the following conditions are found to be invalid for any reason whatsoever, then Planning 2010-01244 is
denied. The following are the conditions and they are attached to the approval:

1) That all proposals of the applicant shall be conditions of approval unless otherwise modified here.
2) That the building permit submittal be in substantial conformance with those submitted as part of this
planning application. If the building permit submittals differ from those submitted as part of the
planning action, a modification of this approval will be required.
3) That the applicants have a licensed, certified arborist on-site to supervise trenching within the
landscape medians to help ensure the trees survival through construction; and the applicant shall
provide the Planning Division the name of the certified arborist who will be on-site prior to
trenching work begins.
4) That all construction materials and equipment be placed within the paved parking area and not
underneath tree canopies or landscaped areas.
5) That lighting shall be directed downward as not to shine onto neighboring properties.

The Ashland Planning Division Staff has received a complete application for the property noted above.

drainage, and adequate transportation can and will be provided to and through the subject property. All improvements in the street
right-of-way shall comply with the Street Standards in Chapter 18.88,Performance Standards Options.

TREE REMOVAL
18.61.080 Criteria for Issuance of Tree Removal-Staff Permit
An applicant for a Tree Removal Permit shall demonstrate that the following criteria are satisfied.The Staff Advisor may require an arborist's report to
substantiate the criteria for a permit:

Ryan,Thank you for your response.
We recognize that the scope of this project is small and that trenching is necessary,but with tree protection such an important issue in
Ashland,our Municipal Code requires that protection measures be taken to ensure that the existing trees are preserved.A Landscape
professional (like Kerry KenCairn)or arborist on site to supervise the trenching work can suffice as taking the necessary steps to ensure
the trees survive.Otherwise any tree removal over 6 inches D.B.H would require a Tree Removal Permit,and would need to be identified
before work begins.
Knowing that you are eager to get started on this project,we will likely condition the approval with having the trench work be supervised
by a Landscape Proffessional or Arborist. Does that work for you?

I really appreciate your feedback. As you will notice on the provided landscape drawing,we intend to trench inside the planting areas,
but as far as possible from the existing trees&shrubs. The disruption of existing trees will be impossible at some locations and as
scheduled on the drawing,those plantings will be replaced as part of the project. When trenching in close proximity to root systems,we
will use our best judgment to determine whether the trenching shall be executed by hand rather than heavy equipment.
Given the foot-traffic at the YMCA and the open trenches,we will provide temporary fencing on all sides of open excavation areas prior to
excavating. We will utilize the same fencing to serve as tree protection and will install the fencing away from trees and whenever
possible;outside of canopy drip lines.
I hope my response is satisfactory. The magnitude of our scope of work is rather small and we will do our best to minimize our impact on
the existing landscape.,

The plans look great,thanks for dropping them by.The only question that we have is regarding the trenching work done in close
proximity to the trees. j

Typically,when a planning action is approved,a tree protection plan and fencing is required.As part of the protection measures,the
requirements state that"no excavation,trenching,or other activity shall occur within the protection zone unless approved from the staff
advisor"(18.61.200.B.7). In the past,we've allowed trenching within the tree protection fencing as long as the work was supervised by
an licensed arborist,and is usually dug by hand to protect the roots.
We understand that your proposal is not the"typical"application,and that the trenching is necessary and cannot be avoided.We can get
the permitting process underway,but before we can make a decision we would like a little more infromation on how the treching will be
perfomed and what measures will be taken to ensure the tree's survival.
