Dear City of Ashland Councilors:
As you are reviewing improvements to the rail crossing at Laurel and Hersey Sts, l
would like to offer a reminder about other unsafe rail crossings--and lack of
crossings.
The Oak Street crossing near A St. has no sidewalks whatsoever, forcing pedestrians
into the narrow,busy street. The only way to avoid going into the street is by
hopping over the tracks, which isn't possible if you are pushing a stroller or using a
wheelchair. Hopping over the tracks on foot, especially at night or when rainy or
icy, can be tricky,too. The next closest crossing, a block away, which is the Water
Street overpass, also lacks sidewalks. The tunnel is narrow and makes it hard for
cars to see pedestrians and cyclists and vice versa. This is a main access point to the
skateboard park, so do doubt may children pass through the tunnel.
11 blocks separate the crossing at Oak Street and the next crossing to the east at N.
Mountain. There is a 13-block, one-mile gap between safe crossings with sidewalks.
This situation exits in the most central part of town, an area that could be especially
pedestrian friendly and offer great opportunities for future commercial and
multiple-unit housing development.
The Ashland Railroad Property Master Plan, now almost 11 years old,provides for a
crossing of the tracks at 4th Street. Last year a petition signed by 90 business owners
requesting the City to construct a pedestrian crossing in the area was submitted and
discussed. Although this issue appears to come up periodically, l am not aware of
any efforts to move forward that are being made regarding this crossing. Railcars
remain parked in the area, dividing the city's center, collecting trash, beer cans,
broken glass,weeds, and cigarette butts. What could be one of the City's most
.pedestrian friendly areas is instead blighted.

priority to those that can have the greatest impact in the long term.

My name is Dr.Shavana Fineberg. I am an Ashland resident&I own a small property in
Josephine County. I am currently a member of the Committee appointed by the Jos Co Plan
Commiss to write a new County Ordinance regulating the placement of new cellular/PCS
antennas in that County. 1 was appointed to that Committee due to my extensive study and
knowledge of the Telecomunications Act of 1996 (known as the TCA) as well as the many
court precedents helping to interpret this Act,and my familiarity with the more recent
Ordinances passed by localities regarding siting of new cellular/PCS antennas.
I wish to make three points tonight:
1- Collocation has become the accepted standard in the newer laws as the first option
required by local governments. The industry has accepted this collocation requirement,has
not demanded any justification for it, and has not been challenging it.The Committee I serve
on includes the participation of 2 reps from the cellular industry association which deals
specifically with local laws.These reps never questioned collocation as our first choice
requirement-nor have they questioned three other new trends-the Applicants'having to
submit monies so the Planning Department could hire an Independent Consultant to
evaluate the technical aspects of the application,intelligent monitoring of emissions,and
the concept of setbacks. These things have simply become standard in the newer local laws.
2- Ashland has focused on visual or aesthetic impact as a siting criterion, but there are
other criteria that have also been accepted by the courts for Planning Depts.to use in
deciding about antenna siting,such as
• effect on property values
•the concept of the"least intrusive'site-which could include,for example,effects on local
businesses,and on"neighborhood character'
*and the concept of"prudent avoidance." The Court of Appeals decision that established
"prudent avoidance"stated that as long as service is not prohibited,"...the municipality
ought to be able to address the concerns of its citizens,and limit political fallout,by deciding
to maximize the distance between the [cell tower] and other ... uses."
3- The rights that the TCA grants and prohibits to localities in legislating in this arena is a
very specialized area of law. To expect the City Attorney to become expert in something of
this magnitude and complexity while he also has many other important city issues on his
plate is not reasonable. Since you will likely not be able to give him the amount of dedicated
time necessary to become expert in this complicated area of law,I urge you to provide him
with advisors who are already immersed in this arena. It is critical that you understand how
the courts have interpreted your rights under the TCA.
From my understanding of this field,I urge Ashland to keep collocation in their law,and to
further revise their law,bringing it up to date and joining the current trend of localities in
strengthening local control. Cell phone service is guaranteed by the TCA-you want to be
able to site the needed new antennas in intelligent locations that place the wellbeing of all
residents as the highest priority. The very best way a locality can be in charge of the sites in
its own domain is via a well constructed Ordinance. I would be happy to show you the draft
that is finally emerging by concensus from the Josephine County committee made up of
individuals with radically varying perspectives.
In sum, my experience leads me to say"get your City Attorney some specialized pro-local
legal input and then write yourselves a law that will hold all aspects of the wellbeing of all of
your citizens as its highest value."

Updating Ashland's Cellular Antennae Installation Laws 11 -30-11
Respect Ashland
Respect Ashland is a community coalition, formed a year ago by hundreds.of Ashland
citizens, to encourage AT&T to collocate their new cell antenna with an already exiting
installation. Recently Respect Ashland has been working with the planning director, the
city attorney, the Planning Commission and the City Council to update Ashland's cell
antenna installation laws with three objectives:
• To give the city as much control and flexibility in locating wireless installations as
is possible within the limits of the 1996 Telecommunications Act.
• To mitigate the possibility of a lawsuit from the carrier, or from citizens because
of decreased property values.
• To determine future location sites as much as possible, so citizens can make real
estate purchases, decisions about where they live, and business decisions based
on that information.
Recommendations
The Respect Ashland Coalition recommends the following actions:
1. Withdraw or defeat the motion to instruct staff to rewrite the wireless ordinance
without the collocation requirement.
The collocation requirement is the only real control the city has on where.cell antennae
are installed. Without it a provider could come in and apply for any number of sites at
any location and — as long as they were aesthetic —there would be absolutely no way to
stop their approval. This could damage local businesses, reduce property values, and
outrage informed citizens.
2. Pass the proposed updates to the wireless ordinance that incorporate the city
council's wording of their interpretation of the wireless ordinance last year in the
AT&T appeal.
These changes to the ordinance clarify what was decided by the city council last year.

3. Include third party verification of technical reports required of the applicant,
including a fee to the applicant to cover the costs and the city choosing the consultant.
No one on the city staff has the expertise to confirm or deny a wireless companies
technical report. Only a qualified technical consultant has this expertise. Just one
example: a third party consultant can perform field tests showing actual field
measurements to support or contradict the computer-based propagation predictions
submitted as evidence in a technical report.
4. Increase the fee for wireless applications to provide the city with funds for legal
consultation and increased staff.
Fees of$5000 and up are becoming common and are not questioned by the wireless
industry. This provides funds for legal consultation. Our city attorney cannot be
expected to become an expert on the 1996 Telecom Act and all the case studies that
relate to it. It also provides funds for additional staff during the short time window an
application must be processed.
Conclusion
The goal of the Respect Ashland Coalition is to create an ongoing, productive, and
mutually valuable relationship with the planning director, the city attorney, the Planning
Commission and the City Council concerning the wireless laws and similar issues in the
future. We support community wide discussion of these challenging issues, so that
together we can forge the best future for Ashland.
