Home My WebLink About2011-319 CONT Addendum - Peck Smiley Ettlin ADDENDUM TO AGREEMENT BETWEEN OWNER (CITY OF ASHLAND) AND ARCHITECT (PECK SMILEY ETTLIN ARCHITECTS) Dated June 14, 2006 and amended by letter Dated May 20, 2009 Addendum made this 1--2- day of 0e LeP-'L- "' , 2011, between the City of Ashland ("Owner") and PECK SMILEY ETTLIN ARCHITECTS ("Architect"). Recitals: A. On or about June 14, 2006 the Parties entered into an agreement (the "Agreement") to plan and design for the construction of Station 2 for Owner's fire department (the "Project") for presentation to the voters for passage of a bond levy to fund the Project. The levy did not pass and, on or about May 20, 2009, the Parties amended the Agreement by reducing the scope of Project and, respectively, the cost of Architect's services to complete the terms of the Agreement. B. The parties desire to amend the agreement again to specifically state: • The time period for Architect to complete the terms and conditions of the Agreement: • How the Project is to be modified; and • The amount of compensation to be paid to Architect to complete its services under the Agreement. City and Consultant agree to amend the agreement in the following manner: 1. The date for completion as specified in Article 11.5 of the Agreement is as provided in Exhibit "A" herein attached and incorporated. 2. The scope of services as specified in Article 2 is modified as provided in Exhibit "B" herein attached and incorporated. 3. The maximum price and schedule of payments as specified in Article 11 of the Agreement is as provided in Exhibit"C" herein attached and incorporated. Any unauthorized expenditure, if any, so far made pursuant to this Agreement is ratified upon City Council approval after this Addendum is signed by both Owner and Architect. 4. Except as modified above the terms of the agreement shall remain in full force and effect. Those services include normal structural, mechanical and electrical engineering services and all other services that are normally or customarily furnished and reasonably necessary for the Project. Exceptions to the June 14, 2006 agreement are as follows: 1. The fees and scope of work are as per the attached Fee Breakdown dated June gth, 2011 and are listed in Exhibit C. 2.
