The subject property is located at 151 Church Street. j COMPREHENSIVE PLAN DESIGNATION: Single Family Residential; ZONING: R-1-7.5; ASSESSOR'S MAP: 39 lE 08AA; TAX LOT: 5202 SUBMITTAL DATE: October 4, 2011 DEEMED COMPLETE DATE: October 20, 2011 STAFF APPROVAL DATE: November 9, 2011 APPEAL DEADLINE: November 21, 2011 FINAL DECISION DATE: November 22, 2011 APPROVAL EXPIRATION DATE: November 22, 2012 DECISION The subject property is located on the north side of Church Street between Scenic Dr. and Almond St. The subject property was created through a two-lot partition in 2005. The parcel slopes at approximately 20 percent to the northeast. There is an existing flag driveway and developed flag lot behind the subject property. i At the time of the partition,there were seventeen trees on the subject parcel. In May 2006, a Modification of the 2005 Partition was applied for to allow for the removal of four trees from the property. Following the tree removal approval in 2006, six of the remaining trees on the property were removed without permits. Two additional trees are requested to be removed as part of this application. This application is to address the removed trees and to modify the approved building footprint. Additionally,the adopted Physical and Environmental Constraints map shows the northeast portion of the property in the Hillside Zone and subject to the requirements of the Physical and Environmental Constraints ordinance (18.62). The applicant had a slope analysis performed by an Oregon Licensed Surveyor and that analysis demonstrates that the properties slope is not the natural grade, was likely cuts, and fill created when the home was constructed at 157 Church Street in the 1970s. The applicant's findings state that a number of the trees have been replanted on the subject property and on other properties under the ownership of the property owner. The application requests to mitigate the PA#2011-01377 151 Church Street/adg Page 1 removals on site and on other property owned by the applicant and by the person purchasing the property. In staff's opinion, some of the trees should be mitigated for on-site and the remaining trees shall have a payment in lieu of planting fee paid into the City of Ashland tree fund. That way the mitigated trees and the verification of compliance is not scattered over numerous properties throughout town. A condition to this effect has been added. The application includes a request to modify the approved building footprint. The previously approved footprint,though conceptual, was generally in keeping with the building footprints of structures in the impact area. This was demonstrated through having a detached garage, front porch near the front property line, narrow facade and longer projection towards rear of the property. The previous.footprint size and the width of the front facade at the street are consistent with the development pattern in the neighborhood. The average front facade near the property is 40-feet. The proposed front facade length is 50-feet. The Historic Commission reviewed the proposal at their November 2, 2011 meeting and felt that based on the footprint and the setback the structure would not be in keeping with the historic development pattern in the neighborhood and suggested that the garage be offset from the front facade of the house by at a minimum of 10-feet. The applicant could also add a front porch that is within 8-feet of the front property line. This would achieve two things, front porches are common design features in the neighborhood and the addition of a porch would break-up the linear facade line and add some architectural details to the front of the structure. These are recommendations since the construction is not subject to the Site Design and Use Standards as it is single-family home construction presumably meeting the other criteria from the code. Staff finds that the applicant's findings for tree removal and subsequent mitigation measures, on-site or payment in lieu of planting addresses the criteria from the code. Additionally,the building envelop modification is approved and due to finding of the Oregon Registered Surveyor that the parcels natural grade is less than 25% slopes and that the areas shown in the City's adopted maps are not accurate of the topography on the site. The criteria for a Tree Removal Permit are described in AMC Chapter 18.61.080, as follows: ! An applicant for a Tree Removal Permit shall demonstrate that the following criteria are satisfied. The Staff Advisor may require an arborist's report to substantiate the criteria for a permit. i A. Hazard Tree: The StaffAdvisor shall issue a tree removal permit for a hazard tree if the applicant demonstrates that a tree is a hazard and warrants removal. I 1. A hazard tree is a tree that is physically damaged to the degree that it is clear that it is likely to fall and injure persons or property. A hazard tree may also include a tree that is located within public rights of way and is causing damage to existing public or private facilities or services and such facilities or services cannot be relocated or the damage alleviated. The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard or a foreseeable danger of property damage to an existing structure and such' hazard or danger cannot reasonably be alleviated by treatment or pruning. 2. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to AMC 18.61.084. Such mitigation requirements shall be a condition of approval of the permit. i PA#2011-01377 151 Church Street/adg Page 2 B. Tree that is Not a Hazard.- The City shall issue a tree removal permit for a tree that is not a hazard if the applicant demonstrates all of the following: 1. The tree is proposed for removal in order to permit the application to be consistent with other applicable Ashland Land Use Ordinance requirements and standards. (e.g. other applicable Site Design and Use Standards). The StaffAdvisor may require the building footprint of the development to be staked to allow for accurate verification-of the permit application; and 2. Removal of the tree will not have a significant negative impact on erosion, -soil stability,flow of surface waters,protection of adjacent trees, oP existing windbreaks; and 3. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone. Nothing in this section shall require that the residential density be reduced below the permitted density allowed by the zone. In making this determination, the City may consider alternative site plans or placement of structures or alternate landscaping designs that would lessen the impact on trees, so long as the alternatives continue to comply with other provisions of the Ashland Land Use Ordinance. 4. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to AMC 18.61.084. Such mitigation requirements shall be a condition of approval of the permit. The application with the attached conditions complies with all applicable City ordinances. Planning Action 2 011-013 77 is approved with the following conditions. Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2011- 01377 is denied. The following are the conditions and they are attached to the approval: 1) That all proposals of the applicant shall be conditions of approval unless otherwise modified here. 2) That all recommendations of the Historic Commission from their November 2nd meeting,.where consistent with applicable standards and with final approval by the Staff Advisor, shall be conditions of approval unless otherwise modified herein. i 3) That all recommendations of the Tree Commission from their November 3rd meeting,where consistent with applicable standards and with final approval by the Staff Advisor, shall be conditions of approval unless otherwise modified herein. 4) That building permit submittals shall include: a) Solar setback calculations demonstrating that all new construction complies with Solar Setback Standard A in the formula [(Height—6)/(0.445 +Slope).=Required Solar Setback] I PA#2011-01377 151 Church Street/adg Page 3 and elevations or cross section drawings clearly identifying the highest shadow producing point(s) and the height(s) from natural grade. b) That calculations demonstrating compliance with the Maximum Permitted Floor Area in the Historic District shall be submitted with the building permit. c) Lot coverage calculations including all building footprints, driveways, parking, and circulation areas. Lot coverage shall be limited to no more than the 45 percent allowed in the R-1-7.5 zoning district. 5) That prior to the issuance of a certificate of occupancy: a) That five (5), five—six foot tall conifer trees which will achieve similar size and stature at maturity as the five (5) conifer trees removed shall be planted on-site and irrigated prior to the issuance of the certificate of occupancy for the new residence. The trees shall be planted and maintained according to the specifications in the City Tree Planting and Maintenance Guidelines. b) That two (2) 1 %2 - inch caliper, eight-foot minimum height deciduous mitigation trees which will equal or exceed the removed trees size and stature at maturity shall be planted on site prior to the issuance of the certificate of occupancy for the new residence. The trees shall be planted and maintained according to the specifications in the City Tree Planting and Maintenance Guidelines. c) The applicant may also pay into the tree account the amount equivalent to the cost of buying and planting the trees that would otherwise have been required to be planted on site,or a minimum of $400.00. As recommended in the pre-application meeting,the following is designed to show a history of what has been approved for this lot, and what is being requested as a modification for the last approval period. There are many maps in existence for this lot. For the purposes of this process I am including as exibit#1 a map that shows all the trees originally located on the lot. Over several approval proceses,there was permission granted to remove 8 trees from the property. Referencing Exhibit 1 those trees were numbered as follows, 1,3,4,5,15,16,17,21.
