Almquist City Administrator City of Ashland City Hall Ashland, Oregon 97520 Dear Mr. Almquist: As you know, City of Ashland (Contractor), and Bonneville Power Administration (Bonneville) are current partners in a Residential Weatherization Program Conservation Agreement, Contract No. DE-MS79-83BP91413 which as amended is referred to as the "Primary Agreement". • The Primary Agreement provides for the installation of air-to-air heat exchangers in homes which exceed the radon level of 5 picoCuries/liter (pCi/1). However, Bonneville has subsequently determined through research conducted by Lawrence Berkeley Laboratories and others that more effective, less costly, and more reliable measures are available for reducing radon in homes than the currently available air-to-air heat exchangers. By allowing new and more effective radon reduction measures, homeowners and/or consumers will have an opportunity to lower their indoor radon levels even more than is currently possible with air-to-air heat exchangers. For the latter reason, Bonneville, in accordance with section 4(c) of Exhibit A to the Primary Agreement, is unilaterally amending Exhibit B of the Primary Agreement to allow for alternative radon mitigation measures such as basement pressurization, sub-slab pressurization or depressurization, or mechanical crawlspace ventilation, in addition to the currently available air-to-air heat exchangers. Once this Amendatory Agreement is in effect, the Contractor can provide these or other radon mitigation measures by requesting and getting Bonneville's approval of a modification of the Weatherization Specifications (Item 1 of Exhibit F) to include specifications for the radon mitigation measure it wishes to employ. l� �V ep11i II�r f Celebrating the U.S. Constitution Bicentennial — 1787-1987 2 • Accordingly, Bonneville unilaterally amends the Primary Agreement as follows: 1. Effective Date of Amendatory Agreement. Unless otherwise selected by the Contractor in accordance with Amendatory Agreement No. 4 to the Primary Agreement, this amendatory agreement shall be effective at 2400 hours on May 1, 1987. 2. Amendment of Primary Agreement_. The Primary Agreement is hereby amended as follows: (a) Section 2 of Exhibit B is hereby deleted and replaced with a new section 2 as follows: "2. Mitigation Measure(s) "If necessary for the mitigation of possible indoor air quality effects pursuant to the procedures contained in Item 12 of Exhibit F, mitigation Measures such as the following are eligible for the Consumer Incentive. If no specification is provided in Item 1 of Exhibit F for the selected Measure, such Measure shall be eligible only after the Contractor receives Bonneville's approval of a specification prepared and submitted by the Contractor.
