4/Purchaser's entitlement is a Firm Resource supplied pursuant to a contract purchase which is not tied to the capability of generating project shall be determined from the
contract identified herein.
5/This Firm Resource is added pursuant to section 12(b)(14)of this Contract. Throughout the term of this Contract,Ashland has a right to a 5(b)(1)(B)Contractual Resource
not to exceed the capability specified in section 2(b)(4)of Amendatory Agreement No.7. Bonneville will sell power to Ashland for the period 10/1/96 through 12/31/97
under Contract No.96MS94924(SP Chase);Ashland may purchase this Firm Resource from another supplier,including Bonneville,upon expiration of the SP Chase. If
Ashland elects to acquire a successor to the SP Chase,Ashland shall notify Bonneville within 90 days of its intent to do so,and provide BPA with the name(s)of the
supplier(s)and a copy of the successor agreement. Any successor agreement must comply with the terms and conditions of Amendatory Agreement No. 7 to this Contract.
