HomeMy WebLinkAbout1951-08 Special Election RESOLUTION A resolution calling a special election in the City of Ashland on the 23rd day of April, 1951, for the purpose of submitting to the citizens of Ashland the following proposals: (1) authorizing the Council of the City of Ashland, for the tax period of July 1st, 1951, to and including June 30th, 1952, to levy an additional or excess tax of Twenty-one thousand three hundred twenty-six and 68/100 021,326.68) Dollars for the purpose of providing additional funds in,the following amounts: One thousand one hundred fifty-four and 84/100 01,154.84) Dollars for General Government, Eight thousand four hundred eighty and no/100 ($8,480.00) Dollars for Street Depart- ment, Three thousand three hundred thirty and 30/100 (3,330.30) Dollars for Police Department and Eight thousand three hundred sixty- one and 54/100 (8,361.54) Dollars for Fire Department, which tax is to be,outside the limitation on taxation imposed by Article XI, Section II of the Constitution of Oregon; (2) an amendment to Article XIX, Section 3 of the Charter of the City of Ashland to increase the authorized mill levy for park purposes from three and ore-half (32) mills to four and one-half (42) mills on the dollar; (3) an amendment to Article XV, Section 2 of the Charter of the City of Ashland changing said section to provide that street inter- sections shall be considered a part of the aggregate cost of any street improvement district; (4) an amendment to Article XIX of the City Charter by adding Section 1-A to provide for the construction within Lithia Park, by the Chamber of Commerce, of a civic service building; designating judges and clerks of said election; providing for notice of said election and declaring an emergency. NOw,THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Ashland: Section,l. That the propositions hereinafter set forth be submitted to the legal voters of said City of Ashland at a special election to be held on the 23rd day of April, 1951, from 8:00 A. M. to 8:00 P. M. at the City Hall, which shall be the polling place for ward No. 1, and the Ashland Junior High School, which shall be the polling place for ward No. 2. Section 2. That at said special election, there is hereby referred to the legal voters of said City the following proposition, to-wit: For the tax period of July let, 1951, to and including June 30th, 1952, the City Council of the City of Ashland, Jackson County, Oregon, is hereby authorized to levy an additional or excess tax of Twenty-one thousand three hundred twenty-six and 68/100 ($21,326.68) Dollars or approximately five (5) mills for the purpose of providing additional funds -1- in the following amounts: One thousand one hundred fifty-four and 84/100 (61,154.84) Dollars for General Government, Eight thousand four hundred eighty and no/100 ($8,480.00) Dollars for Street Department, Three thousand three hundred thirty and 30/100 03,330.30) Dollars for Police Department and Eight thou- sand three hundred sixty-one and 54/100 ($8,361.54) Dollars for Fire Department, which tax is to be outside the limitation on taxation set forth in Article XI, Section II of the constitu- tion of Oregon. Section 3. The ballot title under which said heretofore proposed measure shall be submitted and as the same shall appear on the ballot at said special election herein called shall be as follows: BUDGET INCREASE--REFERRED TO THE PEOPLE BY THE MAYOR AND COMMON COUNCIL - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - Submitted by the Mayor and Common Council of the City of Ashland, Jackson County, Oregon AUTHORIZATION FOR CITY OF ASHLAND TO EXCEED 6jo BUDGET LIMITATION - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - Purpose: To authorize the Council of the City of Ashland, for the tax period of July 1st, 1951, to and including June 30th, 1952, to levy an additional or excess tax of X21,326.68 or approximately 5 mills for the purpose of providing additional funds in the following amounts: ;1,154.84 for General Government, x,81480.00 for Street Department, x3,330.30 for Police Department and ip8,361.54 for Fire Department, which tax is to be outside the limita- tion on taxation set forth in Article XI, Section II of the Constitution of Oregon. 502 Yes. I vote for the budget increase. 503 No. I vote against the budget increase. Section 4. That at said special election, there is hereby further referred to the legal voters of said City the following amendment to the charter of the City of Ashland as follows: - CHARTER AP.IE 4D1V1ENT REFERRED TO THE VOTERS BY THE MAYOR AND COMMON COUNCIL AN ACT To amend the Charter of the City of Ashland, Jackson County, Oregon, by amending Article XIX, Section 3 of said Charter to increase the authorized annual mill levy for park purposes from three.and one-half (32) mills to four and one-half (42) mills on the dollar. BE IT ENACTED BY THE PEOPLE OF THE CITY OF ASHLAND, OREGON -2- That Article XIX, Section 3 of the Charter of the City of Ashland, Jackson County, Oregon, be, and the same hereby is, amended to read as follows: ARTICLE XIX Section 3. The said park commission shall have control and management of all the lands here dedicated for park pur- poses.and of all other lands that may hereafter be acquired by the city for..such purposes. They shall have control and management of all park, funds, whether the same is obtained by taxation, donation or otherwise, and shall expend the same judiciously for beautifying and improving the city's park It shall be the duty of said commission and they shall at the beginning of each month file with the city recorder for the information of the city council and the public, a report of their doings for the preceding month. Such report shall specify all funds on hand and the source from whence obtained. It shall carry a clear statement of all moneys expended and for what pur- pose. All purchases made and all labor performed together with the cost thereof shall be embodied in said report. At the time for making the tax levy for general city pur- poses in each year, the said commission shall cause a careful estimate to be made of the money required for park purposes for the ensuing year, and file the same with the city recorder, whereupon there shall be included in said general levy not to exceed four and one-half (42] mills on the dollar to meet such requirements, which, when collected, shall be deposited with the city treasurer subject to the order of said commission. The levy herein authorized shall be outside the limitation on taxation set forth in Article XI, Section II of the Constitu- tion of Oregon. Section 5. That the ballot title under which said proposed Charter Amend- ment shall be submitted and as the same shall appear on the ballot at said special election to be held as heretofore stated shall be as follows: CHARTER AMENDIEUIT--REFERRED TO THE PEOPLE BY THE MAYOR AND COMMON COUNCIL - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - Submitted by the Mayor and Common Council PARK TAX LEVY AMENDMENT - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - Purpose: To amend Section 3 of Article XIX of the Charter of - the City of Ashland, Oregon, by changing the limitation on the annual tax levy for park purposes from 32 mills to 42 mills on the dollar, all as set forth in said proposed Section 3 of Article XIX. 504 Yes. I vote for the amendment. 505 No. I vote against the amendment. -3- Section 6. That at said special election, there is hereby referred to the legal voters of said City the following amendment to the Charter of the City of Ashland as follows: CHARTER BPLENDMENT REFEhHED TO THE VOTERS BY THE MAYOR AND COMMON COUNCIL AN ACT To amend the Charter of the City of Ashland, Jackson County, Oregon, by amending Article XV, Section 2 of said Charter to provide for assessments for building or rebuild- ing of gutters and drains and to provide that street inter- sections shall be considered a part of the aggregate cost of any street improvement district. BE IT ENACTED BY THE PEOPLE OF THE CITY OF ASHLAND, OREUON That Article XV, Section 2 of the Charter of the City of Ashland, Jackson County, Oregon, be, and the same hereby is, amended to read as follows: ARTICLE XV Section 2. The city council is hereby authorized, in its discretion, by a two-thirds vote of all the councilmen, to cause to be graded, paved, repaved or macadamized any street or alley or any portion thereof within the city, or to build or rebuild any gutter or drain along any street or alley, and cause to be built, rebuilt or repaired any side- walk along any street or alley, each and all to be done in such manner and within such time as the council may direct, and levy and collect the expense and cost of the same, or such part thereof as the council may deem just, by special benefit assessment upon the real estate fronting on such improvements on the same side of the street, and the grading, paving and improving of the street intersections, including sidewalks, curbs, drains and gutters therein, shall be a part of the aggregate cost of any such project and be paid from the assessments levied and collected within any improvement district, and included within said improvement district for the purpose of bearing the cost of the intersections shall be all property owners within one-half block from said inter- sections. Section 7. That the ballot title under which said proposed Charter Amend- ment shall be submitted and as the same shall appear on the ballot at said special election to be held as heretofore stated shall be as follows: CHARTER AMENDMENT--REPERRED TO THE PEOPLE BY THE MAYOR AND COR1MON COUNCIL - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - Submitted by the Mayor and Common Council STREET INTERSECTION AMENDMENT - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - Purpose: To amend Section 2 of Article XV of the Charter of the City of Ashland, Oregon, by changing said section to fur- ther provide that street intersections shall be considered a part of the aggregate cost of any street improvement district and be paid from the assessments levied and collected within any improvement district and that the cost of building or rebuilding of street gutters and drains may be assessed abutting property owners, and included within said improve- ment district for the purpose of bearing the cost of the intersections shall be all property owners within one-half block from said intersections. 506 Yes. I vote for the amendment. 507 No. I vote against the amendment. Section 8. That at said special election, there is hereby further referred to the legal voters of said City the following amendment to the Charter of the City of Ashland as follows: CHARTER AIENDMENT REFERRED TO THE VOTERS BY THE MAYOR AND COMMON COUNCIL AN ACT To amend the Charter of the City of Ashland, Oregon, by amending Article XIX to include Section 1-A to authorize the Ashland Park Commission, with the consent of the Common Council, to permit the Ashland Chamber of Commerce to con- struct on Lithia Park property a civic service building for use as administration offices of the Park Board and Superin- tendent, modern public rest rooms and Chamber of Commerce offices and exhibit rooms and other rublic purposes, said use to be on terms to be determined by the Ashland Park Commis- sion with the consent of the Common uouncil. BE IT ENACTED BY THE PEOPLE OF THE CITY OF ASHLAND, OREGON That Article XIX of the Charter of the City of Ashland be, and the same is hereby, amended by adding thereto Section 1-A to read as follows: ARTICLE XIX Section 1-A. That the Ashland Park Commission, with the consent of the Common Council, shall have the authority to permit the Ashland Chamber of Commerce to construct a civic service building at the entrance to Lithia Park adjacent to the City Hall for use as administration offices of the Park Board and Superintendent, modern public rest rooms and Chamber -5- of Commerce offices and exhibit rooms and for such other public purposes.as the Ashland Park Commission, with the consent of the Common Council, may determine, said use to be on such terms and conditions as the Ashland Park Commission, with the consent of the Common Council, deems in the best interests of the City. Section 9. That the ballot title under which the proposed Charter Amend- ment shall be submitted and as the same shall appear on the ballot at the special election shall be as follows: CHARTER AKENDMENT--REFERRED TO THE PEOPLE BY THE MAYOR AND COMMON COUNCIL - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - Submitted by the Mayor and Common Council CIVIC SERVICE BUILDING - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - Purpose: To authorize the Ashland Park Commission, with the consent of the Common Council, to permit the Ashland Chamber of Commerce to construct a civic service building at the entrance to Lithia Park adjacent to the City hall for use as administration offices for the nark Board and Superintendent, modern public rest rooms and Chamber of Commerce offices and exhibit rooms and for other public purposes as the Ashland Park Commission, with the consent of the Common Council, may determine, said use to be on such terms and conditions as the Ashland Park Commission, with the consent of the Common Council, deems in the best interests of the City. 506 Yes. I vote for the amendment. 509 No. I vote against the amendment. Section 10. That the City Recorder is hereby requested and directed to give due notice of such special election herein called as provided in the Charter and ordinances of the City of Ashland, that is to say, that this resolution be published in the Ashland Daily Tidings, a news- paper of general circulation printed and published in said City, at least once ten (10) days prior to the date fixed herein for holding said election and copies of this resolution shall be posted in con- spicuous places in each ward in the City of Ashland for at least ten (10) days prior to said special election. -Section ll. That Mrs. Celia Berninghausen is hereby appointed judge and Mrs. Ruth Hargrove and Mrs. Rita Champion are hereby appointed clerks of said election for the first ward of said City; and Mrs. -6- Zella Converse is hereby appointed judge and Mrs. Henry Jones and Mrs. Art Haskins are hereby appointed clerks of said election for the second ward of said City. Section 12. That as regards the holding of said election, it shall, in all particulars, be conducted in conformity with Article IV of the Charter of the city of Ashland. Section,l3. That inasmuch as it is imperative that the special election be held as soon as possible in view of the fact that a special election has already been called for April 23, 1951, it is deemed necessary for the peace, health, safety and general welfare of the citizens of the City of Ashland that an emergency be, and the same is hereby, declared to exist and this resolution shall be in full force and effect from and after its adoption by the council and approval by the Mayor.
