HomeMy WebLinkAbout1917-07 Spec Election Tax for Publicity & Park Purposes RESOLUTION CALLING SPECIAL ELECTION WHEREAS, by an amendment-of the Charter of the city of Ashland, Oregon, proclaimed by the Mayor, November 21st, 1914, provision was made for the levying of a tax and donating $300.00 thereof to the Southern Oregon Chautauqua Association, for the 9 maintenance and upkeep of certain of its park lands used by the public, and ~ WHEREAS, it is now proposed to purchase said park lands fromwthe said Chautauqua Association, and the city assume the burden of maintaining and caring for said lands, thus relieving the Association for such expense, and WHEREAS, such burden will naturally fall on the Ashland Park Commission, and will require additional funds, and WHEREAS, it is deemed by the oommon council that the $300.00 heretofore donated to the Chautauqua Association for the maintenance of such grounds should be placed in the park funds of the city for the use of said Park Commission, and WHEREAS, under authority granted to the city council by and under section 6 of Ordinance No-357, which ordinance was duly approved on the 18th day of August, 1908,.,and authorizing the common council-,of the city of Ashland, Oregon, to call a special election at any time for the purpose of amending the Charter of said city, upon a resolution proposed by said common council, which election shall only be held after due notice thereof and the appoint- ment of judges.of said election shall have been given by publication in a newspaper,published in the city of Ashland,or by oonspioiously posting a notice in each of the wards of said city not less than ten days prior to any such special election. NOW THEREFORE, BE IT RESOLVED, by the common council of the o/iitty of Ashland, Oregon, in regular session assembled, this fJ~"`"e day of March, 1917, that a special election of the qualified electors of the city of Ashland, be and hereby is called and appointed to be held on the 4~ ay of • Y i i Maroh, 1917,for the purpose of submitting to the electors of said city, the following amendment to the Charter of said city- for the approval or.rejection of said electors, to wit:= ---TITLE An Act to amend Section 23, of Article VII, of the existing Charter of the city of Ashland,Oregon,said Charter being that oertain'act of the Legislative Assembly of the state of, Oregon, filed in the office of the Secretary of state, October.14th, 1999, entitled "An Act to amend and act, entitled 'An act to j incorporate the city of Ashland, in Jackson county, Oregon, and define the power thereof,' filed in the office of Secretary of I State, February% 25th, 1995, amending the sameas amended by all acts subsequent thereto, either'of the Legislative Assembly of the i state of Oregon, or by vote'of the qualified electors of the city of Ashland,Oregon, as said Section 23, was added to and made a part of said Article VII of the Charter, and made effective by the proclamation of the Mayor of the city on the 21st day of.November, I 1914. BE IT ENACTED BY THE PEOPLE OF THE CITY OF ASHLAND,OREGON: That Section 23 of Article VII of the present Charter of the city of Ashland,Oregon, as said section was added to and made a part of the Charter, and which became operative.by the proclamation of the Mayor of said city, on the.2lst day of November,.1914, be amended to read as follows Section 23: The Common Council, shall at the time of making the annual-lavy for the expenses of the city,as provided in Section 2, of Article VII, of the city charter, include in such levy,for the uses and purposes hereinafter specified, an amount not exceeding one-half mill on the dollar on the assessed valuation of the property of said city, taxable by law, for-state and county purposes, and the amount,which may be received from such levy shall only be expended by the common council in such manner and j, -2- for such purposes as the council shall deem best calculated to promote the interests of the city in the extension of its trade and i business,the development and exploitation of its attractions and 'I resouroes,and the improvement of conditions effecting the health, comfort and welfare of the people of the said city. Provided,-. however, that the sum of $300.00"'of the revenue produced by said II levy, which was heretofore donated to the Southern Oregon Chautauqua Association, shall be placed in the park fund of the city, and shall be used by the Ashland Park..Commission.for the upkeep,maintenance and improvement of the parks of the city. Prodded, further, that theamount provided for by this section, shall not be included in the annual expense of the city, but the council is authorized to levy the amount herein set out, over and above the fifteen mills on the dollar of valuation, as limited by section 2 of Article VIIo of the Charter of the city of Ashland. BE IT FURTHER RESOLVED, That the following are designated as the voting places of each of the wards of said city for said special election i First Ward: Voting Place,city-,fire hall, Fourth street. Second Ward: Voting,Place, McCarthy Building. Third Ward: Voting Place, City Hall. And the following named persons are appointed judges of said election: j. BE IT FURTHER RESOLVED, that the City Recorder bre, and he is hereby directed to give notice of such special election and the appointment of 3udges of election by publication thereof, in a newspaper, published in the city of Ashland, and of the proposed amendment to the Charter of said city, to be voted upon at least ten days prior to said election, as required by the laws of the state of Oregon, and the ordinances of said city, as in such oases made and provided.
