WHEREAS, upnn the recommendation of the Commercial Club of the city of Ashland, by and through a committee appointed f or the purpose, the common council is requested to call a special i• election for the purpose of empowering the council to lease or sell, for a term of not exceeding twenty-five years, whatever interest the city has or may hereafter acquire in and to the surplus mineral waters now being piped into the city of Ashland, over and above that consumed at the public fountains by the general public,said surplus waters to be used in a private sanitarium for bathing and other medicinal purposes, and ITHEREAS, the common council has duly considered said recommendation and request, and now.deem it advisable that a special election be called for the purpose of amending the Charter,to the end that the common council may be empowered to dispose of said surplus waters as requested, and WHEREAS, under authority granted to the city council,by and under Section 6,of Ordinance number 357,whioh ordinance was duly approved on the 18th day of August,1908, and authorizing the common council of the city of Ashland,Oregon,to call special electione,at any time for.the purpose of amending the Charter of said city,upon a reso- lution proposed by the said Common Council,which election shall only be held after due notice thereof,and the appointment of judges of said election,shall have been given by publication in a newspaper,published in the city of Ashland,or by conspicicusly posting a notice in each of the wards of said city,not less than ten days prior to any such special election. NOVI THEREFORE, BE IT RESOLVED,By the common council of the city of Ashland,Oregon,in regular adjourned session assembled, this 6th day of Dec ember,1916,that a special election of the quali- fied electors of the city of Ashland,be,and hereby is called and appointed to be held on Tuesday,the 19th day of December,1916,for the purpose of submitting to the electors of said city,the following amendment to the Charter of the city,for the approval or rejection of said electors, to wit: I A N A C T--- To amend Article 7 of the existing Charter of the city of Ashland, Oregon, by adding thereto, a section to be known as Section 24, authorizing and empowering the Mayor and common council of said city to lease for a term of not exceeding twenty-five years, the use of all the city's right, title and interest in and to its and gas, surplus mineral waters,nover.and above that now consumed, or which may hereafter be consumed by the general public, for such price and upon such terms and conditions as the common council may,in its discretion,determine. BE IT ENACTED BY THE PEOPLE OF THE CITY OF ASHLAND,OREGON: That Article VII, of.the present Charter of the city of Ashland, Oregon, be amended, by adding thereto a section to be known as Section 24, which shall read as follows: Section 24.- The common council, at any regular or adjourned meeting thereof, by a two-thirds vote of the council, is hereby authorized and empowered to lease for a term of not exceed- the ing twenty-five years, the use of allrcity's right, title and interest in and to its surplus mineral waters and gas now being piped into the city of Ashland, or which may hereafter be so piped, over and above that now consumed, or which may hereafter be consumed by the general public, and the citizens of Ashland, at the city's public fountains, for such price, and upon such terms and condi- tions ae-..the common council may, in its discretion, determine. Provided, however, that the waters and gas so leased shall be used i in a sanitarium for bathing, drinking and other medicinal purposes only. the Recorder be BE IT FURTHER RESOLVED, That the City be, and he is hereby authorized and directed 'to give notice of such and special electionrthe.appointment of judges of election by . publication thereof, in a newspaper printed and published in the city of Ashlarid,and of the proposed amendment to the Charter of i setid city to be voted upon, at least ben days prior to said. election, as required by the laws of the state of Oregon, and the Charter and ordinances of said city, as in such cases made and provided, and said Recorder is further directed to prepare a suitable ballot title and have all necessary ballots printed, as provided by the general Laws of Oregon, and the said Charter and ordinances of the city of Ashland. BE IT FURTHER RESOLVED, That the judges and clerks of the general city election -t© be held on the 19th day of December,1916, be, and they are hereby designated as the judges and clerks of this special election, and the poling places for said special election shall be the same as for the said general election.
