HomeMy WebLinkAbout1918-06 Special Election RESOLUTION CALLING FOR SPECIAL ELECTION. WHEREAS, the voters of the State of Oregon, at an election duly held in this state on the 4th clay of June, 1917, adopted Section 14-a of Article II of the Constitution as a part of the Constitution of said state, and the same is now in full force and effect, AND, WHEREAS, it is necessary that the Charter of the City of Ashland be amended to conform to said Section 14-s of Article II of the said Constitution of Oregon, I FOW,THEREFORE,BE IT RESOLVED, by the Common Council of the City of Ashland,Oregon, in regular. adjourned session assembled., this ust day of October, 1918,that a special election of the qualified electors of the City of Ashland,be,and hereby is called, and appointed to.be held on Tuesday, the 5th day of November, 1918,for the purpose of submitting to the electors of said City the following amenlment to the Charter of said City of Ashland for approval and adoption, or rejection by said electors, to-wit: TITLE. An Act of municipal legislation relating to the hplding of elections in the City of Ashland,OregDn,in conformity with the provi- sions of Section 14-a of Article II of the. Constitution of the State of Oregon,and amending the Charter of the City of Ashiaid , by amending Sections I, IL, IV, XI and XII of Article IV,repealing Section V of Article IV and amending Section II of Article II and Section II of Article XIX. THE PEOPLE OF THE CITY OF ASHLAND OR ORDAIN AS FOLLOWS:? SECTION I. That Section I of Article IV of the Charter of the City of Ashland be and the same hereby is amended to read as follows; "See. I. Within thirty days and not less than fifteen days prior to the first Tuesday after the first Monday in November ine ad's even numbered year, the City Council shall order a biennial election for l I i I I city elective officers, of which election notice shall be given by pub- lication in a newspaper published in the City, or by notice signed by the City Recorder, and posted by the Chief of Police in three conspic- uous places-in said city, one notice to be y, posted in ease ward, not less than ten days prior, to'ea h election, which notice shall specify the officers to be elected, and the times and places of holding; said election." ` of article IV SECTION II. That Section II of the Charter of the City of Ashland be, and the same hereby ic; amended to read as follows; "Sec. II. The City Election shall be held at the same time and place that the General Biennial Election for state and county officers is held in said City, but the election precincts and officers for said election shall be those selected according to law for said General Biennial Election'.' SECTION III. That Section IV of Article IV of the Chartar of the City of Ashland be, and the same hereby is, amended to read as follows; "Sec, IV, That all persons who are qualified electors under the laws of the State of Oregon,and have resided thirty days in the City,and,ten days in the precinct or ward,immediately preceding the preeiv;c-r-5 ,i election, shall be entitled to vote in their respective ^ mds at such election.'' SECTION IV. That Section V of Article IV of the Charter of the City of Ashland be and the some F hereby is, repealed. SECTION V. That Section XI of Article IV of the Charter of the City of Ashland be, and the some hereby is, amended so as to read as follows; "Sec. %I. Each ward shall elect two councilmen at each biennial election." SECTION VI. That Section YII of Article IV of the Charter of the City of Ashland,, be, and the some hereby is, amended so as to read as follows; I I . "Section XII. Every present officer of said City, either elective or appointive, shall serve until the expiration of his respective term and until. his successor is elected and qualified." Section VII. That Section ti of Article II of the Charter of the City of Ashland be, and the same hereby is amended to read as follows: "Section II. The term of the elective officers shall begin on the first day of January following any biennial election, and the terms of office for the mayor, treasurer and recorder and the councilmen shall be for two years, unless elected to fill a vacancy." Section VIII. That Section II of Article XIX of the Charter of the City of Ashland be, and the same hereby is amended to read as follows: "Section II. The certain Board created by a vote of the quali- fied electors of the City of Ashland, Oregon, at a special election held on the 15th day of December, 1908, which became effective by the proclamation of the Mayor, published on the lath day of December; 1908, and known and designated as the "Ashland Bark Commission", be i and the same, as constituted and created by said charter amendment, and as now existing, is hereby perpetuated and continued as five members with all the powers conferred and duties imposed by said charter amendment and ordinances of the City of Ashland. Pro7ided that at the general election to be held in the year 1918,-one commissioner shall Vie-elected to- serve for the term of two years from the first day of January, 1919, and,,one commissioner to serve for the term of one year from the first day of January, 1920, and that at the biennial election in 1920 there shall be elected three Park Commissioners for the term of two years beginning January 1,1921, and.one Park Commissioner for the term of one year beginning Jan. 1, 1922, and that all said Park Commissioners thereafter elected shall be elected at the said biennial election and for a term of two years, provided that the present incumbents shall be allowed to serve for the full term for which they have heretofore been elected." BE IT FURTHER RESOLVED that the voting place in each of the / wards shall be the same as the place designated for the holding of,elections for the state and county officers, and that the polls shall be opened and closed at _the same time as the polls are opened and closed for said gener&l election. BE IT FURTHER RESOLVED, that the City Recorder be, and she is hereby directed to give notice of such special election and the appointment of judges of election and of the proposed amendment to the Charter of said city to be voted upon, by conspicuously post- ing a notice in each of the wards of said city, not less than ten days prior to the said election, as required by the laws of the State of Oregon, and the charter and ordinances of said City, as in such cases made and provided. _ The foregoing Resolution was adopted by the Common.Council of the City of Ashland, Oregon, under a suspension of the rules, at a regular adjourned meeting thereof, held on the 18th day of October, 1918, by the following vote: Yeas 11 n~~ ' Nays To all of which I hereby certify.
