BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF ASHLAND: Section 1 That an amendment to the Charter of the City of Ashland, Jackson County, Oregon, be and the same is hereby proposed and referred for submission to the legal voters of said City at a.special election to be held in said City on the 8th day of JJ 1948, which Charter amendment to be so referred is as follows:, CHARTS AMENDMENT REFERRED TO THE VOTERS BY THE MAYOR AND COMMON COUNCIL APT ACT To amend an act entitled "An Act to amend an act entitled lAn Act to incorporate the City of Ashland, in Jackson County, Oregon, and to define the power thereof,' filed in the office of the Secretary of State, February 21, 1889, and the acts approved February 23, 1895, amending the same, filed in the office of the Secretary of State October 14, 1898, as amended by an act filed in the office of the Secretary of State January 31, 1903, and as amended by an act filed in the office of the Secretary of State February 3, 1903, and as amended by an act filed in the office of the Secretary of State February 10, 1905, and as amended by the legal voters of said city at elections held subsequent to the year 1908 and to.amend all acts whether mentioned herein or not, amending said act, adopted by the Legislative Assembly, or by the vote of the people." BE IT ENACTED BY THE PEOPLE OF TPIE CITY OF ASHLAND,. OREGON That an act entitled "An Act to amend an act entitled lAn Act to incorporate the City of Ashland in Jackson County, Oregon, and to define the power thereof,' filed in the office of the Secretary of State, February 21, 1889, and the acts approved February 25, 1895, amending the same, filed in the office of the Secretary of State October 14, 1898, as amended by an act filed in the office of the Secretary of State January 31, 1903, and as amended by an act filed in the office of the Secretary of State February 3, 1903, and as amended by an act filed in the office of the Secretary of State.February 10, 1905. and as amended by the legal voters of said City at elections held sub- sequent to the year 1908, and as amended by all acts whether mentioned herein or not, amending said act, adopted by the legislative assembly or.by the vote.of the people," be and the same is hereby amended to read as follows: ARTICLE XIX \ Sec. 3. The said park commission shall have control and management of all the lands here dedicated for park purposes and of all other lands that may hereafter be acquired by the city for such purposes. They shall have control and management of all park funds, whether the same is obtained by taxation, donation or other- wise, and shall expend the same judiciously for beautifying and improving the city's parks. It.shall be the duty of said commission and they shall at the beginning of each month file with the city recorder for the information of the city council and the public, a report of their doings for the preceding month. Such report shall specify all funds on hand and the source from whence obtained. It shall carry a clear statement of all moneys expended and for what purpose. All purchases made and all labor performed together with the cost thereof shall be embodied in said report. At the time for making the tax levy for general city purposes in each year, the said commission shall cause a careful estimate to be made of the, money required for park purposes for the ensuing year. and file the same with the city recorder, whereupon there shall be included in said general levy not to exceed three and one-half (32) mills on the dollar to meet such requirements, which, when collected, shall be deposited with the city treasurer subject to the order of said commission. Section 2 That.W. C. Mitchell, George S. Rose and Louise G. McNair are hereby appointed judges of said election for the first ward of said City, and Rosa Dodge Galey, Margaret Biegel and.Philip Wendt are hereby appointed judges of said election for the second ward of said City; that the City Hall is hereby designated as the voting place for the first ward, and the Ashland Public Library is hereby designated as the voting place for the second ward in said. City. Polls will be open from eight o'clock, in the forenoon to eight o'clock in the afternoon on the date herein fixed for said election. Section 3 That the ballot title under which said proposed charter amendment shall be submitted and as the same shall appear on the ballot at the said special election to be held on the Sth day of Ju~44 1946, shall be as follows; CHARTER AME11I)MENT--REFERRED TO THE PEOPLE BY THE, MAYOR AND COMMON COTIOIL. Submitted by the Mayor and Common Council- PARR TAX LEVY AMENDMENT Purpose: To amend Section 3 of Article XIX of the charter of the City of Ashland, Oregon, by changing the limitation on the tax levy for park purposes from two and one-half (22) mills to three and one-half (3z) mills on the dollar, all as set forth in said proposed Section 3 of Article XIX. 100- YES I vote for the amendment, .10$- NO I vote against the amendment. Section 4 That the City Recorder is hereby requested and directed to give due notice of such special election herein called as provided in the Charter and ordinances of the City of Ashland, Oregon, that is to say, that this Resolution " be.published in the Ashland Daily Tidings, a newspaper of general circulation.' printed and published in said City, at least once ten days prior to the date fixed herein for holding said election; and copies of this Resolution be posted in conspicuous places in each ward in the City of Ashland for at 'least ten days prior to said special election. Section 5 That as regards the holding of said election, it shall, in all par- ticulars, be conducted in conformity with Article IV of the Charter of the. City of Ashland. Section 6 That inasmuch as a special election has already been called for 1946, and inasmuch as additional funds are needed for the operation. and maintenance of said park during the period 1946-47, it is deemed necessary for the peace, health, safety, and general welfare of the citizens of the City of Ashland that an emergency be and the same is hereby declared to exist. And this resolution shall be in full force and effect from and after its passage by the Council and approval by the Mayor. The foregoing Resolution was duly passed under a suspension of the rules at an adjourned meeting of the Council held on the lath day of June, 1946; the vote being as follows:- Ayes: ' Nays: C Approved this 11th day of June, 1946.
