ORDINANCE NO.
AN ORDINANCE LEVYING SPECIAL BENEFIT ASSESSMENTS IN THE
AMOUNT OF $260,226.41 IN THE MATTER OF UTILITY CONSTRUC-
TION, CURBS, GUTTERS AND PAVING IN LOCAL IMPROVEMENT
DISTRICT NO. 54, AND DECLARING AN EMERGENCY.
WHEREAS, the Common Council of the City of Ashland, Jackson County, Oregon,
has heretofore proposed to construct utilities, curbs, gutters and
paving, during 1984; and
WHEREAS, the total assessment for utilities, curbs, gutters and paving in
said district is in the amount of $260,226.41; and
WHEREAS, the Common Council does hereby determine that the total assessments
for.the property and individuals assessed are reasonable assess-
ments; and
WHEREAS, special benefit assessments should now be levied against the prop-
erty benefitted and fronting on such improvements to defray the
expense thereof;
NOW, THEREFORE, THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. That Local Improvement District No. 54 consists of improvement
of utilities, curbs, gutters and paving as hereinafter designated in Section
2 and is described as follows:
Kensington Subdivision
Ashland Business Park Subdivision
SECTION 2. That there are hereby levied special benefit assessments in the
respective amount and against the respective property in the City of Ashland
as follows:

SECTION 3. That if the owner of any property so assessed for such local
improvement in the sum of $100.00 or more, at any time within ten days after
notice of such assessment is first published, so desires, he may have the
payment thereof extended in the manner and under the provisions of the
Bancroft Act.
SECTION 4. That inasmuch as it is necessary to provide the funds immediately
with which to pay the cost of such local improvements, it is hereby deemed
necessary for the public peace, health, and safety of the citizens of the
City of Ashland that an emergency be, and the same is hereby, declared to
exist, and this Ordinance shall be in full force and effect from and after
its passage by the Council and approval by the Mayor.
The foregoing Ordinance was first read at a regular meeting of the City
Council of the City of Ashland held on the 3w~fday of
1984, and was passed to a second reading and duly adopt on the/,7,",'-day of
1984.
