HomeMy WebLinkAbout2328 Adding Chapter 13 Oiling Unimproved City Streets , ORDINANCE NO. ~3 a AN ORDINANCE ADDING CHAPTER 13 TO TITLE 13 OF THE ASHLAND MUNICIPAL CODE, AND WHICH RELATES TO THE OILING OF UNIMPROVED CITY STREETS. THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: SECTION 1. There is hereby added to Title 13 of the Ashland Municipal Code, Chapter 13, which is to read as follows: "Chapter 13.13 STREET OILING Sections: 13..13.010 Permit--Required. 13.13.011 Notification. 13.13.012 Type of Oil. 13.13.013 Safety Measures. 13.13.014 Liability of Applicant. 13.13.015 City Exclusion. 13.13.016 Removal of Oil. 13.13.017 Violation--Penalty.. 13.13.010. Permit--Required. It is unlawful for any person, firm or corporation to oil or have oil applied, to any public street or alley without first making application to the City Engineer, accompanied by an application fee of ten dollars ($10.00) and obtaining a permit therefor, as provided in this Chapter. 13.13.011 Notification. The permit described in the prece- ding Section shall not be valid until after the City Engineer has had seven (7) days notice of the proposed street or alley oiling, and that the street or alley has'been graded by the City if,such is appropriate in the opinion of the City Engineer. 13.13.012 Type of Oil. The oil to be applied to the street or alley shall be of a type approved in writing by the City Engineer. 13.13.013 Safety Measures. The applicant must provide and maintain such safety measures, barricades, warning devices, speed control signs, and other safety measures as designated by the City Engineer, and these shall be maintained for the period of.time deter- mined by the City Engineer. -17 , Ordinance No. d3-2~ 13.13.014 Liability of 'Applicant. The applicant, by accep- ting the permit, shall assume liability for all damages occurring to any person as a result of the street oiling or any violation of this Chapter, and shall hold the City harmless thereon. 13.13.015 City Exclusion. The requirements of this Chapter do not apply to oiling by the City of Ashland. 13.13.016 Removal of Oil. The oil applied may be removed by the City in the discretion of the City Engineer when it is deter- mined that the oil is worn out or the street is damaged so that such removal is appropriate. 13.13.017 Violation-=Penalty. Any person, firm or corpora- tion violating any of the provisions of this Chapter, or failing to comply with them, is, upon conviction thereof, punishable as prescribed in Section 1.08.020 of the Ashland Municipal Code relating to infractions."
