Dear Roy:
Enclosed is a copy of the warranty deed which you recently signed showing the
county recording numbers in the upper left corner. Also enclosed is a check for one dollar
as called for in the document. As we discussed before the fence will be relocated after the
sidewalk is constructed.
Also enclosed is an agreement, that, when signed, will allow you use of the right of
way between the fence line and your property. Would you please sign and return this
document at your earliest opportunity.

RIGHT OF WAY
DES C RIP T ION
Commencing at the Northeast corner of Lot 4 of Block 29 in
the City of Ashland, Jackson County, Oregon, according to the
official map of the City of Ashland adopted November 5, 1888 and
combined with that survey filed as number 5941 in the office of
the Jackson County Surveyor;
THENCE South 23 degrees 47 minutes 07 seconds West (deed
record South 23 degrees 43 minutes West for a distance of 45 feet)
along the Southeasterly boundary line of said Lot 4 which is
common to the Northwesterly right of way line of Water Street, for
a distance of 45.00 feet to a 5/8 inch iron rod as set and shown
on filed survey number 5941, as set forth hereinabove, said point
being the TRUE POINT OF BEGINNING;
THENCE North 50 degrees 45 minutes 53 seconds West (deed
record North 50 degrees 50 minutes West) along the Northeasterly
boundary line of that tract of land as set forth in Document No.
74-14789 of the Official Records of Jackson County, Oregon for a
distance of 55.97 feet to a point;
THENCE leaving said Northeasterly boundary line, South 43
degrees 40 minutes 23 seconds East for a distance of 48.935 feet
to an angle point;
THENCE South 09 degrees 01 minutes 45 seconds East for a
distance of 16.145 feet to a point in the existing Westerly right
of way line of Water Street, as resurveyed and set forth on that
survey assigned number 5941 and on filed in the office of the
Jackson County Surveyor;
THENCE North 23 degrees 47 minutes 07 seconds East along said
right of way line for a distance of 17.42 feet to the point of
beginning. Together with and subject to covenants, easements,
restrictions of record and those apparent on the land.
