ASHLAND STREET TREE EASEMENT
1. Upon the following terms and conditions, Grantor grants to Grantee a perpetual easement for t;"~
planting, care, maintenance and repiacement of one (1) tree on the land described below ('tree
easement area')
2. The tree easement area is described as that portion of frontage of Gmntor's property abuttin;] Ashland
Street necessary to adequately piant, care and maintain the number of tree~ specified above. The tree
easement area shall not exceed five feet in length or width for each tee as measured from or along the
right-of-way line of Ashland Street. This grant of easement is subject to all existing easements and ri.qhts-
of-way of record. Grantor's property is within the City of Ashland, Jackson County, Oregon and is
described as:
Lot 1, Block 'B', 'FOSTER TRACTS', to the City of Ashland, Jackson County, Oregon.
EXCEPTING THEREFROM the following: The North 20.0 feet of Lot 1, Block "B',
'FOSTER TRACTS', to the City of Ashland, Jackson County, Oregon.
ALSO, EXCEPTING THEREFROM that portion of the above described property conveyed
to the State of Oregon, by and through it's Department of Transportation, Highway
Division, by Warranty Deed, recorded November 30, 1978, as Instrument No. 78-27203,
Official Records of Jackson County, Oregon.

3. This grant of easement shall be binding upon, and shall inure to the benafit of, Grantor and its
successors and assigns and Grantee and its assigns.
4. This grant of easement imposes no other obligations or restrictions on Grantor and Grantor shall not
be in any way restricted from using all of Grantor's land in the customary manner except as provided in
this grant of easement.
