GOUNTZ RECORDER. BY A DEPUTY, i k4t 1 ~~;%r ~ 7 • THIS INDEITTURE WITMESSETH, That John P. Walker and Mary Walker, his wife, of Ashland,Oregon, were the legal owners in fee simple and in possession of a valid water rigrlt and water ditch on June first,1890; that said water ditch carried z e 4 inches of water, and was taken from Ashland Creek in Jackson County, Oregon, above the head works of the "Applegate ditch" which is now owned by the S.P.Railroad Compan~r at Ashland, Oregon; that said water right and ditch owned by the grantors herein and hereinabove referred to, was known as the "John P. Walker" ditch, and located by him in the year 18-7/, and condudted the water from the intake of the said ditch to the farm of the said grantor above the city of Ashland, Jackson County, Oregon, the said ditch pass- ing through the said city; that on or about the first day of June,1890, for a valuable consideration then and there agreed upon between the city of Ashland, a municipal corporation, and the said grantor John P. Walker, the said water right and water ditch was sold and turned over to the said city of Ashland, which has ever since said date been and now is the owner thereof, and this deed is now made as, for and of the date of June first, A.D.1890, to supply a deficiency in the record of said water right, arising from failure to record the deed or transfer. NOW,THER X40RE, in view of the premises above set out and for and in consideration of the sum of One Hundred ($100.00) Dollars, Gold Coin of the United States, to them paid, receipt whereof is hereby acknowledg- ed, the said John P. Walker and 1~ary Walker,his wife, have this day and do hereby bargain, sell and transfer unto the said city of Ashland that certain water ditch and water right hereinabove referred to,to-wit: The John P. Walker water ditch and water right, located and taken from Ashland Creek in the City of Ashland, Oregon and above the said city on to-wit: the day of and which was con- ducted through the said city by an open ditch to the farm of the said John P. Walker from the time of its location to the year 1890. That this deed is made at this time as above set out to supply a deficiency in the record, and to supply record of the said transfer. I ~ TO HAVE AIID TO HOLD the said premises, to-wit, the said water right and water ditch unto the said city of Ashland, a municipal corporation, and unto its successors and assigns forever. IN WITNESS WHEREOF we have hereunto set our hands and seals this the 29th clay of May,A.D.1905. Done in presence of: ea 47 Sealy State of Oregon, :ss. County of Jackson. On this the 29th day of May,A.D.1905, person- ally came before me, - Cz; en, a Notary Public in and for said County aixi State, the within named John P. Walker and Mary Talker his wife, to me personally known to be the identical persons described it and who executed the within instrument, and acknowledged to me that They executed the same freely for the uses and purposes therein naloed.
