FOR DESTr<UCTIO'It` OE SAM DUST PILE ON OLD ITSF'ENGER HILI, SITE ON
ASHIMM CREEK.
This agreement made this the 27th day of May, 1907, by and
between the City of Ashland , a imanicipal corporation, party
contractor,
of the first part, and C. A. Fliason, party of the second part,

That whereas, the said first party has heretofore deemed
and adjudged it expedient to destroy the saw dust pile on the
old Ifessenf er 'Hill site on Ashland., Creek and the com.1o,on council
of said City of Ashland did cause notice to be published orb
the 13th day of I%y, 1907, inviting bids for the destruction
of saIDd saw dust pile , a printed copy of such notice for bids
being; hereto attached and ma(.e a part of this contract;
APvTD RE?EAS IN PURSUANCE, to said call for hids the said
second party did make and file with the said City ?ecorder
a bid for the destruction or removal of said saw dust pile
in accordance with the conditions named in said advertisement
for bids and to the satisfaction of the dater Corm-vi.tt.ee of the
said Common council for the sum of $700.oo
AND WIRMEAS, the said second party was adjudged by the
mayor and common council of the said city to be the best and
lo-,..est bidder in the premises, and he having filed his certified
check as required in said notice, the contract to destroy said
saw dust pile was duly awarded by the said cor_+~Yion council to
the said second party.
NOW THEREFORE, the aid second party agrees with the first,
party that he will destroy or cause to be remzved the said
deposit of saw dust and debris and entirely to the satisfacticn
of the Water Cor_nittee of +he said corr.on coi.ancily so that it
shall cease to be damaging to the clean and wholesome water

service of said city.
Special reference is made to the call for bids hereto
attached and it shall be made a part of this contract.
The said second party agrees that he will not foul, pollute
or damage said city viater service and will pay all damages to
persons or property arising from fire or other agency or method
employed by him for the destruction or removal of said deposit
of saw dust and th~t he will execute the job and do all the work
thereofby the lst day of September, 1907.
The said first party, upon completion of the destruction
of the deposit or pile of sal,; dust, as herein referred to will
pay to the said second party the sum of $700.oo .

principal and C. rR Eliason as surety are held and fin tl-y
bound unto the City of Ashland, Oregon, in the sum of One Thous-
and dollars, lawful coney of the TTnited States, for the payment
of which we respectively hind ourselves, our respective heirs,
and assigns, firmly by these presents.

the aboge named principal,C. A. Eliason, has entered upon a
contract with the City of Ashland, Ore,on wherein he agrees
to destroy the deposit of saw dust on the old Messenger chill
site to the satisfaction of the water committee of the Common
Council of said city, so that it shall cease to be damaging
to the clean and wholesome water service of the said city and
that in the performance of such contract he will not foul poll-
ute or damage the water service of said city and will pay all
dama6cs to persons or property arising from fire or other agency
or methods employed for the destruction or removal of said depos-
it of saw dust and to perform such work of destruction to com=
pletion on or prior to the first, day of September, 1907. and
do all thereof for the sum of $700.oo;
NOW THEREFORE, if the said principal sbAll well and
faithfully perform his said contract and keep and maintain the
same inviolate then these presents shall be void, otherwise
to be and remain in full force and effect.
Done this the 27th day of May, 1907.

In the matter of your application for extension of
time in which to destroy the sawdust pile at the old Messesnger
Mill site on Ashland Creek, under your agreement with the city,
executed May 27th, 1907, I have to advise you that the 8omon
