THIS INDENTURE WITNESSIETH That Horace Goble and Annie Goble, his ;wife, of the County of Jackson and State of Oregon, for and in consideration of the sum of Twenty-Five Hundred Dollars, to us paid, have bargained and sold and by these presents do bargain, sell and convey unto the City of Ashland, a municipal corporation of Jackson County, Oregon, created by an Act of the Legislative Assembly of said State, the following described premises situated and being in the County of Jackson and estate of Oregon, to-wit: The west half of the southwest quarter of the northwest quarter of section 16, Tp. 39, S. R. 1E. W.M.: Excepting and reserving therefrom:- (a) six acres owned by G. W. Crowson and Wealthy Crowson, his wife, on October 23rd, 1903. (b) One acre as reserved by H. B. Carter and wife in deed dated August 25th, 1£393, which said deed is recorded on page 95, Vol. 27 of Deed Records of Jackson County, Oregon. (c) a parcel of land 50 feet by 100 feet heretofore sold by G.W. Crowson and Wealthy Crowson to the City of Ashland and now owned by the City of Ashland. (d) A parcel of land containing about 6ne-fourth of an acre deeded by the said G. W. Crowson and Wealthy Crowson to one Teeters. (e) The right of the said G. W. Crowson and Wealthy Crowson, their heirs and assigns, to a private roadway across the said described promises as reserved in a deed from the said Crowson and wife to the grantors herein recorded in Volume 48 at page 337, Deed Records of Jackson County, Oregon. (f) Also except.Ing and reserving therefrom the riparian rights of Ashland Creek as it flows through said land and also reserving a riF-ht of way for the Ashland Electric Sight and Power Company's water ditch, water flume, or water pipe acVoss said land, with right of ingress and egress for constructing and repairing the same,these reservations as to riparian rights cf Ashland Creek and as to right -1- 4 1 of way for water ditch or water pied baing made by the aforesaid G. W. Crowson and Wealthy Crowson in a dead to grantors executed October 23rd, 19u3, and recorded in Volume 48 at page 387, Deed Records of Jackson County, Oregon. (g) Also reserving to H. E. Stone and C. H. Hosleyi in the event of their fulfillment of an option prior Lo wia 14th uay of v'dbrua:ry, Horace Goble 1909, given by the said grantorA to the said h. E. Stone and O.K. Hosley, Dated February 14th, 1907, whereby the grantor,hora:ao Goble giv3s, grants and agreos to convoy to tl-_ --aid H. P. Stone and C. H. Hosley, upon the payment by them or their heirs or assigns "of the further sun of one hundred Dollars and the further consideration" therein named`; the exclusive riErt of cay for a pipe Lime (with the necessary right o of entrance u)-:on for the purposes of construction and repairs) through the land above described, said pipe to be laid through said.tract in a: northerly and southerly direction and at the most convenient points thereof, but not so as to damage or interfere with any of the buildings on said tract; wherein the said grantor, Horace Goble, also agrees fur trie above consideration to deed to the said Stone and Hosley, their heirs of assigns a tract of land 100 feet east and arrest and 150 feet north and south, the west i_Lad of which tract shall be the east line of the tract of land owned and used by the City of Ashland as an intake for its lower water system and sizall extend 40 feet further south than said tract so used by said city. if the said ti. h:. Bosley shall neglect and fail to fulfill all the conditions and cor,^ply with all the prior to the 14th day of Feb., 1909, agreements set forth in said. option, as above referred to,nthen and in that case all reservation£, limitations and qualifications &pecified and relating to said option as herein recited in paragraph "g; shall be absolutely void and of no effect and this conveyance by the grantor shall be free of all incumbrances, limitations and qualifications except as above set forth in paragraphs marked '(;:~:a, b, cy d, e and f) in this instrument. _2 i + TO HAVE AND TO HOLD the said premises with their appurtenances unto the said City of Ashland, itd successors and assigns forever. And we, the said Horace Lobel and Annie Goble, do hereby covenant to and with the said City of ashland, its successors and assigns, that we are the owners in fee simple of itai.d premises; that they are free from all incumbrances and that we will warrant and defend the same from all lawful claims whatsoever. Eggleston, Recorder of Ashland in said Oounty and State, the within named horace noble and Annie Goble, his wife, to me personally known to be the identical peroons described in and who executed the foregoing conveyance, and acknowledged to me that they executed the same freely for the uses and purposes therein named.
