Recites:- Jacob r'agrer,Charles i.Klum and Albert G.Rockfellow,of Jackson County,being the owners of a certain ,water Ditch which takes the water for the same out of Ashland or :ill Creek about tvo miles above the Ashland 1,ill,do release and relinquish to the President and Directors of the Rogue River Valley Woolen ~'.,anufacturing Co.,and their successors,the prior right rhich we hold of the water used and conveyed in the above described ditch and which has heretofore been used for mining purposes; that is to day,this relinquishment is granted to the said ';oolen ~.anufacturing Company whenever the said Company .hall build their factory and put in operation one set of machinery the -ein at Ashland,but not for ary other pu!-pose,provided further that this relinquishment may extend to the running of two sets of machinery if the said Company desire to put up an add-itior..al set of machinery; the water of the said Ditch to be used by the said Company when necessary for the running said one or two sets of machinery as the case may be on account of the insufficiency of eater in said Ashland or gall Creek for running the machinery as aforesaid,but for no -other purpose; the 'ater Ditch herein- I -4- before mentioned is the same ditch taken out of said Ashland or kill Creek about two miles above the Ashland .gill vd leading to what is known as the Davenport Diggings. The set of machinery hereby intended is meant to comprise six broad looms &nd the nec- essary fixtures to operate the same. No Acknowledgement. ------o------ 7.
