This indehture Witnesseth,lhat we,Frank R.
Pendleton and Ella FeLdletonjusband and wife,of the County
of Snohomish and State of California,for and in consideration
of the sum of ONE DOLLAR (J1.00) to us paid,have bargained
s
and sold and quit-claimed and by these presents do bargain,sell
and quit-claim unto the City of Ashland Jackson Couyty,Ore6on,
the following described premises situate and being in the
County of Jackson and State of Oregon,to-wit:
The right to lay and maintain a water-pipe
along the Southerly side of the hereinafter described tract of
land (said pipe-line to be as near to the said South line as is
practicable and to be placed under grourd to a depth which will
not interfere with the plowing and cultivating of said tract)
and to enter upon said lard at any and all times for the purpose
of replacing and/or repairing the same conditioned that no un-
necessary damage shall be done to the premises hereinafter des-
cribed,to-wit:
Beginning at the intersection of the South line
of _lot 7 in Section 5 and the Test Boundary line of Donation
Land Claim No.38,in Twp.39 South of an e 1 East of the '.Y.,in
Oregon 534.20 feet forth of the 9orthwest corner of said D.I.C.
N0.36; thence north 89 degrees 51 minutes ;hest along said South
line of said lot Seven in said :section 5 a distance of 727.40 feet
thence Forth 44 degrees ZC minutes East 31.gO feet; thence Forth

36 degrees 47 minutes vest 59.30 feet; thence Korth 53 degrees
16 minutes East 462.40 feet; thence South 68 iegrees 16 minutes
East 72.80 feet; thence forth 30 degrees 33 minutes East 299.00
feet; thence South 71 degrees 12 minutes Fast 16C.70 feet to
the said West boundary line of D.L.C.138; thence South no degrees
9 minutes West along said 7est boundary line 527 feet to the
place of beginning; containing 5.75 acres.
