AN ORDINANCE AMENDING THE ASHLAND MUNICIPAL CODE TO ADD TO IT A NEW
SECTION CONCERNING TREE REMOVAL AND STUMPS, AND ALSO TO AMEND AMC
9.08.190 SO AS TO ADD TO THE DEFINITION OF NUISANCES, THE IMPROPER
REMOVAL OF TREES AND STUMPS.
THE PEOPLE OF THE CITY OF ASHLAND ORDAIN AS FOLLOWS:
SECTION 1. There is hereby added to the Ashland Municipal
Code Chapter 13.16 a new section which shall be 13.16.065 and which
shall read in its entirety as follows:
"13.16.065 Stump Removal. A removal permit shall include
a requirement that trees be removed at ground level or
lower and that if removed below ground level, the surface
will be restored to finish grade and that any regrowth
which occurs shall be promptly removed. Any failure by
the applicant to comply with this requirement is declared
to be a nuisance and subject to being removed by the City
pursuant to the terms set forth in AMC 9.08.190 and is
also declared to be a violation of the nuisance chapter so
as to subject the violator to the penalties set forth in
AMC 9.12.060."
SECTION 2. AMC 9.08.190 entitled "Declaration of Nuisance
- General Nuisance" is hereby amended so that subpart A shall read
in its entirety as follows:
"(a) The acts, conditions, or objects enumerated and
defined in section 9.08.020 through section 9.08.180 and
in section 13.16.065 are declared public nuisances and
such acts, conditions, or objects may be abated by any of
the procedures set forth in section 9.08.200 through
section 9.08.230."
The foregoing was first read at a regular meeting of the
Common Council held on the ~-~ day of -/~..~_~.~--,-~ , 1990 and
passed to its second reading and duly adopted on the ~_~6 ~ day of
