HomeMy WebLinkAbout2391 Amends ORD 2069 SB 405 Opportunity to Recycle Act ORDINANCE NO. - Z AN ORDINANCE AMENDING ORDINANCE NO. 2069, ADOPTED BY THE CITY OF ASHLAND, JACKSON COUNTY, OREGON, SETTING FGRZ'H `_L'HE MANDATES REQUIRED BY SENATE BILL 405 (CHAPTER 729 OREGON LAWS 1983) KNOWN AS THE "OPPORTUNITY TO RECYCLE ACT," WHICH IS NOW INCORPORATED IN CHAPTER 459 OF OREGON REVISED STATUTES: THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: SECTION 1. Section 12. of Ordinance No. 2069 shall be amended to read as follows: SECTION 12. The City reserves the right to grant franchises for collecting recyclable materials. If the Common Council determines that it wishes to grant a franchise for such service, it shall first submit any proposal to the Ashland Sanitary Service, Inc., which shall have the first right of refusal of the franchise. However, even if no recycling franchise is granted, Ashland Sanitary Service, Inc. must provide all customers within the City of Ashland with the Opportunity to Recycle and must comply with all the requirements of Senate Bill 405 (which became Chapter 729, Oregon Laws of 1983), as now incorporated in Chapter 459 of Oregon Revised Statutes, together with all rules and regulations promulgated thereunder. SECTION 2.
