ORDINANCE NO.
AN ORDINANCE OF THE CITY OF ASHLAND ANNEXING A CONTIGUOUS AREA
TO THE CITY OF ASHLAND, OREGON AND PROVIDING FOR AN EFFECTIVE
DATE. (CBM ANNEXATION)
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. The land described in Exhibit "A" attached hereto and
made a part hereof is contiguous to the City of Ashland and is
located in Jackson County, Oregon, and is hereby annexed to the City
of Ashland as provided in Section 2 of this ordinance.
SECTION 2. Upon the effective date of this ordinance, the City
Recorder, in accordance with ORS 222.170, is hereby authorized and
directed to make and submit to the Secretary of the State of Oregon,
a copy of this ordinance, a copy of the Statement of Consent from the
landowners of the tract annexed, and a copy of the ordinance
dispensing with the election on the proposed annexation, and also
upon the effective date hereof, the City Recorder is authorized and
directed to submit a copy of this ordinance to the County Assessor
and County Surveyor of Jackson County, Oregon.
The foregoing ordinance was first read on the 20th day of October,
1987 and duly PASSED and ADOPTED this J'~ day of November, 1987.

as No. 86-19956 of the Official Records of Jackson County, Oregon, said rod
bears North 78°45'23" West, 3,435.60 feet from the corner common to Sections
112 12, 13 and 14, Township 39 South, Range I East of the Willamette Base and
Meridian, Jackson County, Oregon; thence North 00°04'09" East along the Westerl
right of way line of Tolman Creek Road, as said road has been resurveyed, y
monumented and set forth on Recorded Survey Nos. 5613, 8604 and 9812, 331.14
feet to a 3/4 x 30 inch galvanized iron pipe for the TRUE POINT OF BEGINNING;

that Boundary Line by Agreement as set forth in Document No. 86-19955 of the
Official Records of Jackson County, Oregon; thence North 88°10'59" West along
said Boundary Line by Agreement and the present city limits line as set forth
in City of Ashland Ordinance No. 2109, 137.42 feet to a found 5/8 inch iron
rod; thence North 05°54'53" East, 415.56 feet to a found 5/8 inch rod; thence
leaving said Boundary Line by Agreement North 05°54'53" East along the present
city limits line as set forth in City of Ashland Ordinance No. 2293, 3.10 feet
to a found 5/8 inch iron rod; thence South 89°09'19" East, 289.69 feet to a
found 5/8 inch iron rod situated in the Westerly right of way line of Tolman
Creek Road, as hereinabove referred to; thence leaving said city limits line
South 00°04'09" West along said Westerly right of way line, 330.34 feet to the
point of beginning. Containing 2.586 Acres, more or less.
ALSO INCLUDING, a strip of land 60.0 feet in width lying 30.0 feet on each side
of, when measured normal therefrom, the following described centerline: Commencing
at a 5/8 inch iron rod situated at the Southeast corner of that tract or parcel
of land set forth in Exhibit 'A' in that document recorded as No. 86-19956 of
the Official Records of Jackson County, Oregon, said rod bears North 78'+,023"
West, 3,435.60 feet from the corner common to Sections 11, 12, 13 and 14, Town-
ship 39 South, Range I East of the Willamette Base and Meridian, Jackson County,
Oregon; thence South 00°04'09" West along the Westerly right of way line of
Tolman Creek Road, as said road has been resurveyed, monumented and set forth
on Recorded Survey Nos. 5613, 8604 and 9812, 433.96 feet to a point in the
present City Limits Line as set forth in City of Ashland Ordinance No. 1350;
thence leaving said right of way line, South 89°54'06" East along said City
Limits Line which is parallel to the South boundary line of Section 11, 30.00
feet to a point in the centerline of Tolman Creek Road, as hereinabove set
forth, said point being the TRUE POINT OF BEGINNING; thence North 00°0341"
East along the centerline of said road, 1,541.79 feet to a found 5/8 inch
iron rod; thence continuing North 00°03'41" East along said centerline, 0.40
foot to a point' and there terminating. Extend and/or shorten the sidelines
of said strip of land to close upon the existing City Limits Line as set forth
in City of Ashland Ordinance No. 1350, as required.
Subject to any and/or easements and/or rights of way record and those apparent
on the land.
