Procedure on Selection of Park Commissioner Position #3

SUMMARY
On November 6, 2012, Park Commissioner Rich Rosenthal was elected to Council Position #5.
Commissioner Rosenthal intends on resigning from the Park Commission effective December 31, 2012
which will result in a vacancy on the Park Commission with a term ending December 31, 2014.
BACKGROUND AND POLICY IMPLICATIONS:
City Charter does not provide for a separate process of appointment to the Park Commission when a
vacancy occurs.
City Charter states that a vacant elective office shall be filled within sixty (60) days (which is March 1,
2012) by the City Council electing some qualified person to fill the vacancy. The appointee’s term of
office shall begin immediately upon appointment and shall continue until a successor, elected at the
next biennial election takes office for the unexpired term. (Biennial elections take place very two
years; next biennial election will be November, 2014)
This is the first time that a vacancy has occurred mid-term for the Park Commission. There is no prior
process or action that can be provided as an example.
STAFF RECOMMENDATION AND REQUESTED ACTION:
Council consideration of the following:
1.Request the Park Commission to work with the City Elections Officer to determine a
process for selection of appointment. The position will be advertised in the local
newspaper and City website with a deadline for applications.
2.Once the Park Commission has completed the process of selection and have made a choice
for appointment, a request for approval and appointment by Council will be placed on the
agenda for their consideration no later than March 1, 2013.
OR
Council can choose to conduct the selection process for filling the vacant Park Commission
Position #3. Direction would be provided to the City Elections Officer on the process for this
appointment.
