Warranty Deed L. Applegate & C. F. Blake to Kentnor & Buick
This Indenture, made the tenth day of December in the ye4r of our
Lord one thousand and eight hundred and Seventy four. Between L. Applegate
and C. F. Blake Trustees of Ashland Cemetry and their successors in office
the parties of the first part and W. W. Kentnor and D. S. K. Buick Trustees
of Ashland Lodge No. 45, I. 0. 0. F. the parti es of the second part.
Witnesseth, That the said parties of the first part for and in consideration
of the sum of Eighty five ($85.00) Dollars Gold coin of the United States
of America to them in hand paid by the said parties of the second part, the
receipt whereof is hereby acknowledged, have granted, bargained and sold,
conveyed and confirmed, and by these presents does grant, bargain and sell,
convey and confirm unto the said parties of the second part, and to their
successors in office forever, all that certain lot, piece or parcel of land
lying and being in the Precinct of nshland, County of Jackson, State of
Oregon and bounded and particularly described as follows, to wit;-
Beginning at a post 16.25 chains west, and 48 links S. 80 W. of the
South East corner of Donation Land claim No. 42, in Township 39 South, Range
1 East Willamette Meridian thence S. 80 W. 317 links to a post from which
a Black Oak 18 In. diam. bears N. 880 W. 51 lks distant - thence S. 820 E.
310 lks to a post in center of walk in said grounds, thence N. 80 W. 317
links to a post in center of Gateway - thence N. 82 W. 310 lks to the
place of beginning containing 98/100 acre be the same more or less. In trust
for the use and purpose of a cemetry, anc the said parties of the second
part are hereby empowered to sell the said ground for burial purposes, and
to receive and collect the money arising from such sale - Together with
all and singular the tenements, heredi taments and appurtenances thereunto
belone in or in any wise appertaining, and the reversion and reversions,

remainder and remainders, rents, issues and profits thereof; and also
the estate, right, title, inte-est, in and to said property, possession,
all
claim and demand whatsoever, as well in law as in equity, of the said
of the first part, of, in or to the above mentioned premises, and
parties
every part and parcel thereof, with the appurtenances - To Have and to
Hold all and singular the above mentioned and described premises, together

with the appurtenances unto the said parties of the second part, and
heirs and assigns forever, their successors in office forever. - And the
said parties of the f first part do by these presents Narrant and Defend

Peace in and for said county of Jackson the within named L. "Ipplegete
and . F. Blake whose names are subscribed to the annexed instrument as
the parties thereto, personally known to me to be the same persons described
in and who executed the said annexed instrument as the* parties thereto
who upon examination duly acknowledged to me that they executed the same
freely and voluntarily, and for the uses and purposes therein mentioned
