Dear Dick:
On April 14, 2004, the Bonneville Power Administration (BPA) and the City of Ashland
(Ashland) executed the Commercial and Industrial Standard Offer (C&ISO) under Ashland's
Purchase of Conservation Agreement, Contract No. 01 ES- 10379.
Section (a)(2)(A) under Project 4 of Ashland's Exhibit A states "Ashland shall submit Sub-
Project proposals to Bonneville using the Commercial Industrial Proposal Requirements
Doucument." In addition, Section (a)(2)(D) states, "Once Bonneville's written acceptance has
been received by Ashland, Ashland may proceed with the Sub-Project as provided under this
Exhibit A."
BPA and Ashland agree to a waiver of these requirements for the Shop N Kart Sub-Project only.
All other requirements in this Project 4 remain unchanged. All future projects subrrdtted by
Ashland under the C&ISO must adhere to the rules and procedures set forth in Exhibit A.
If the foregoing is acceptable, please have Mr. Grimaldi sign both originals of this waiver and
return one original to me. The second original is for your files.
