The location of your use is partially within the A.G.FORDYCE DLC 43 of Section 4, Township 39 South, Range 1 East, Willamette Meridian, Jackson County, State of Oregon, as shown on the attached segment of BP A Drawing No. 177342, marked as Exhibit "A" and a CVO Electrical Systems, LLC drawing marked as Exhibit "B". You shall not make any changes or additions to your use of BPA's fee owned property without BPA's review and written approval. Any other uses and utilities on BPA's property must be applied for separately. This agreement is entered into with the express understanding that it is not assignable or transferable to other parties without the prior written consent of BP A, This agreement is revocable at will by BPA and does not modify, change, or otherwise alter the rights BPA acquired by Deed. BP A may terminate this agreement upon 30 days written notice. The subject use of BPA's fee owned area has been determined not to be a hazard to, or an interference with, BP A's present use of this property for electric transmission purposes. Accordingly, there is no present objection to such use. However, if BPA should determine at any time, that your use has become a hazard to the presently installed electrical facilities of BP A, or any facilities added or constructed in the future, or if such use should interfere with the inspection, maintenance, or repair of the same, or with the access to/within the property, you will be required to stop your use or remove such hazard or interference from BPA's fee owned property at no expense to BPA. BY ACCEPfING THIS LAND USE AGREEMENT YOU ARE AGREEING TO THE FOLLOWING CONDITIONS 1. Inform BP A once the construction of your approved use is complete. 2. The construction/installation of your approved use must be completed by August 23,2010. If you have not completed your project by the above date, you must inform BPA five working days in advance to receive an extension. 3. Maintain a minimum distanc~ of at least ~ feet between your facilities and the transmission line conductors (wires). 4. No storage of flammable materials or refueling of vehicles or equipment within the BPA FEE area and BPA's transmission line Right of Way (R/W). 5. Damage to BPA property, resulting from your use, shall be repaired or replaced by BP A at its option. The actual costs of such repair or replacement shall be charged to and paid by you. 6. Modification of your present use requires BP A's written approval prior to implementation. 7 . ENVIRONMENTAL RES PONS ffi ILITY : You shall be responsible for and comply with all procedural and substantive environmental requirements imposed by local, state or federal laws or regulations applicable to the facility. You shall timely notify BP A of any reportable release of hazardous substances or breaches of environmental requirements and shall mitigate and abate adverse environmental impacts of its actions. You shall hold BP A harmless for any and all liability arising from the violation of such environmental requirements by you, Violations of such requirements by you shall make this agreement voidable at the election of BP A. 8. Equipment, machinery, and vehicles traveling on BPA's right-of-way shall come no closer than 25 feet to any BP A structure or guy anchor ground attachment point. 9. Disposal of overburden on BPA fee owned property and BPA's Right-Of-Way will not be allowed. Any damage to BP A property resulting from the proposed use shall be repaired at the Applicant's expense. 10. Access to BP A transmission line system by BP A and/or its contractors shall not be obstructed at any time. TEMPORARY FENCING 11. Temporary fences and contractor access gates are permitted as shown on Exhibit "B". Original substation fencing and gate configuration must be restored to original condition or better within 7 working days of completion of approved project. At no time is the contractor permitted within the BPA energized facility. 12. To ensure the safety of workers and the uninterrupted operation of the BPA transmission facilities, the applicant shall employ a BP A approved safety watcher 2 Case No. 20080316 Tract No. MT A V -SS-1 during any construction activities occurring while installing and removing the temporary fence and gate or when operating any equipment that has the potential to reach or come within 20 feet of the energized facilities. Please contact this office for a current list of BP A approved Safety Watchers. 13. As was discussed in our meeting on 6/27/08, BPA agreed that the use of qualified electrical workers (City personnel) to install and remove the temporary fencing is acceptable. BPA will not require the City to use a BPA-approved safety watcher. DISPOSAL OF EXCESS SOIL 14. A BP A Pollution Abatement Clearance (PAC) has been provided and marked as Exhibit "C", and will need to be strictly followed in the management of disposing of excess soil. Please provide BP A a record of all activities pertaining to disposal of excess soil. IN ADDITION.. THE FOLLOWING IS BROUGHT TO YOUR ATTENTION You agree to assume risk of loss, damage, or injury which may result from your use of the easement area, except for such loss, damage, or injury for which BP A may be responsible under the provisions of the Federal Tort Claims Act, 62 Stat. 982, as amended. It is understood that any damage to BP A's property caused by or resulting from your use of the easement area may be repaired by BPA, and the actual cost of such repair shall be charged against and be paid by you. Nuisance shocks may occur within the right-of-way. Grounding metal objects helps to reduce the level of shock. It is suggested that construction equipment be grounded with a drag chain. Construction/installation, use, and maintenance of the three (3) Feeders, one (1) Potential Transformer and the instillation and removal of the temporary fence and gate system shall be at no cost to BP A. BP A seeks your help maintaining the integrity of the electrical transmission system. Please report any Vandalism or Theft to the BPA Crime Witness program at 1-800-437- 2744. Cash rewards of up to $25,000 will be paid should information lead to the arrest and conviction of persons committing a crime. BPA shall not be liable for damage to your property, facilities, or injury to persons that might occur during maintenance, reconstruction, or future construction of BP A facilities as a result of your facilities being within the right-of-way.
