HomeMy WebLinkAbout1973-026 Agreement Otis Street 73-117682 •A G R E E M E N T ' We the owners of the following described land, which land is being minor land partitioned and shall be commonly known as Minor Land. Partition Number 214, located in the City of Ashland, County of Jackson, State of Oregon: Beginning at a point which is south 65°40'east 1146 feet from the northwest corner of D.L.C. 40, twp 39 south ..range 1 east of the W.M., Oregon; thence east on the north line of the Sanderson tract, described in volume 72, page 350, Deed Records of Jackson County, 417 feet to the west line of Laurel Street, in Ashland, Oregon; thence north 3' east 100 feet, more or less, to the intersection of the west line of Laurel Street with the south side line of Otis Street; thence north 89°57' west on the.south side line of Otis Street 400 feet, more or less, to a point which is north 13°15' east from the place of beginning; thence south 13°15' west 110 feet, more or less, to the place of beginning, excepting Drager Street Right-of-Way and the.tax lot 1100, assessor's map 39-lE-4BC. As the owners of such property, we hereby consent to the improve- ment of Otis Street abutting the proposed.lots of said Minor Land Partition by the City of Ashland when the City desires to improve this street; further, as the owners of such lot, we do consent to the proportionate payment of the cost of such improvements. This Agreement is to be binding upon ourselves, our heirs, executors and assigns and it is our express intention that this Agreement shall run with the land, so that consent to the improvement of the street and the duty to pay for such improvement shall be binding upon the future owners of the lot. The consideration for this Agreement is the consent of the City of Ashland to the Minor Land Partition of the land without the immediate installation of street improvements in front of property owned by ourselves on Otis Street in the City of Ashland.
