This agreement made and entered into this 28th day of 1by,
1907, between the City of Ashland, Oregon, the party of the
first part, p!_irsuant to an order of the common council of said
city, and B. Reach and Susan Beach, his wife, the partly of the
second part, witnes seth:
That for and in consideration of the sum of one dollar,
paid by the party of the first, part,, the receipt of which is
hereby acknowledged, the party of the second part, hereby grant
and permit the party of the first part a right of way for a
sewer lateral across the southwest section of the land of the
party of the second part to connect the premises on lot 16
of Hargadine Tract now there or ivhich may be hereafter located
on said lot 16, with the sevier lateral 1.-7est of Gresham street
and between Vista street and Hargadine street at either one of
the Y's located respectively 66 1/2 feet east of lamp-hole of
said lateral or 94 feet east of said lar_rrp-hole of the lateral
aforesaid which connects with the Gresham street sewer, said
tract of land over which said right of way is granted, and the

part , is described as follows: A tract of land south of Hargadire
street, more particularly described at page 115 in volume 9 in
Deed Records of Jackson County, O--egon, also a tract of land
south of Hargadine street more particularly described at vol.
10, page 507, Deed Records, excepting land listed to B. Beach
f'ron 1:1rc; on Gresham. street and excepting land listed to H. F.
Pohland, et al, and exc ept, ink; land listed to Frank D. and Louise
Swingle and excepting land listed to Ida Veghte and C. H. Veghte
and exc ept.inG land listed, in hargadine Tract to H. M. Hiatt.
The said right of ~Yay is granted the party of the first
part solely and particularly for the purpose of affording the
o.vner or owners of lot 16 of Hargadine Tract, above named

convenient connection for any building; on said lot 16 with the
selmer in Sewer 'District No. 7 at any suitable point on the line
of the sewer lateral aforena±ed and as the same appears on the
map of the said Viewer District No. 7 on file in the office of
the City 'Recorder of Ashland, Oregon.
The party of the first part] agrees to secure that time care
shall be observed by any person or persons who may be entitled
to use such right of iva.y that, in digging and laying such sevier
co 1~:nection, a s lit-t le dan. age as possible shall be done to the
premises of the party of the second.- part, and that like care
shall be observed in ertering upon said right of way for pur-
poses of inspection and repair.
It is mtually agreed that all covenants and agreements
he4-ein contained shall extend +o and be obligatory upon the
heirs, executors, administratorg and,a signs of the respective
r;arties .
In witness whereof the parties to these presents have here-
unto set their hands and seals, this the 28th day of ITay, 1907.
