I This agreement made this 11th dear of April , 1907 , by
and between the City of Ashland , a mlinicipal corporation
party of the first part and Z. 3. Phipps At party of the

THAT r HN.: EAS THF ~AID FIRST PARTY has heretofore deemed
and adjudged it expedient to construct a sewer in what is des-
ignated as Sewer District Number.

have been made by the City L an[,i filed in the office
of the City Recorder , and the game duly approved by the Mayor
and common council of the said city ;

cause notice to be published inviting bids for the construc-
tion of the said sewer a printed copy of such notice for
bids being hereto attached and ma,,o a part of this contract,
together with the profile , plena and specifications therein
referred to ;
AN".) AS IN :PUR&SUANC to said call for bids the said
second party did make and file with the said City Recorder a
bid for the furnishing of all the material for and the con-
struction of the said sewer agreeable to said plans . profile
and specifications and form and manner of payment therefor ,

AND ~'Hf.~z AS the said second party was adjudged by the
'said mayor and comi}-,on council to be the best and lowest biXder
in the premises , and he having fled his certified check as
required in said notice , the contract to furnish all the
mate~ial for and construct the said sewer was duly awarded by

the said common council 'to the said second party which con-
tract embraces the man-holes and lamp-holes called for in the
said plans and specifications the same as the sever itself
and putting in gates at head end lamp-holes on a
r~rrt streets ;
NOW TH R-1,70RE , the said second party agrees with the
first party that he will construct said sewer , lamp-}doles
and man-holes an.; furnish all the material therefor , timely
and in a good ancf first class manner , the sewer to be of the
usual vitrified sewer tile , and the bricks of good thorough
burned quality , and to do all thereof , and furnish all there-
of subject to the af,proval of the City Eu gineer , or some other
suitable person to be appointed for that purpose by the common
council of the said city , or the property owners along the
line of the said Sewer District .
Special reference is made herein to the plans , profile
and specifications approved by the common councill aforesaid
and they are deemed and considered a part of this contract .
Special reference is also ma-'e to the call for bids here-
to attached and it shall be made a part of this contract , and
it is express*grcied that all .,!ork , material and method and
terms of compensation shall conform thereto.

the property benefitted by the said sewer , special benefit
benefit assessments and proceed to collect the same as rapidly
as possible , and in an amours that shall be amply sufficient
to pay the contract price of aforesaid,
No pipe shall be coirered until the samo shall be approved
by the Sewer Inspector , but he must examine the same as often
as onvenient , and either approve or designate any defects
therein as soon as practicable and at least when every fifty
feet are laid

Then the work and material on any section shall be appr.ov-
ed by the sewer inspector the same shall be covered as soon as
practicable .
a The work shall be commenced as soon as practicable and
shall be completed by the Twentieth day of June , 1907 , and
on failure to complete the same the seeond party agrees to
forfeit Five (5) dollars per day to liquidate damages for the
failure to complete the same within the said time limit .
The second party assumes all responsibilities for damages
by the elements and from any unforseen obstructions that may
opeur , escept suits or injunctions which shall suspend any
and all damages while in force .
The second party shall out up and maintain such barriers
and signals as will effectually prevent any accident in co -
sequence of enbankments , material and excavations, and^~M~
shall be liable for any a d all accidents occasioned byAth4f4
negligence, or that of .`agents , servants and employees
Defective and condemned material must be removed from the
line of server .
Care must be taken to protect the water pipes , and in
case the same or any of them are damaged by the sedond party
the second party shall repair the same at his oven expense .
The contract+ar shall, where practicable , make suitable
provisions for the safe and free passage of persons and
vehicles by , or over the work when in progress of construe-
tion of the sewer and man.-holes and lamp-holes and refilling.
The provisions in specifications relating to open cut
work may be iVaived by the Inspector where open cut is not
practicable

Specifications.

Excavation.
All exc avat i Gn shall be done by open, cut f ron the surface

feet lvvi-de , or to be excavated one (l) foot on each side of
the center line of the sever .
The contractor shall at -,is o.-n cost keep the trenches

with travel on the street or to incommode occupant=s of adjoining
property . Wrenches shall not be opened more than two hundred
(200) feat in advance of the layirC of the server.
Backfill ing•
Backfilling shall follow close after the construction of
the seder , and in no case be riore than one hundred (100) feet
in the rear •
The filling of the earth around and on top of the sewers
shall be done 1 with the u ost care and in a manner to obtain
the greatest compactness and solidity possible .
For that purpose the ea rt,Ii shall b o laid and rammed in
regular layers not more than one (11 foot thick up to the
su rfacq,6-f the street , or thoroughly soaked viith ivat er , as may
be directed All work of restoring the surface of the streets
and alleys shall be done to the satisfaction of '-he street

The price paid for earth and rock excavation shall cover
the whale cost of excavating the trenches an refillink; the
same with earth , restoring the street and. haulm away the
surplus rnsiterial if any , as well as the whole cost of pumping
bailir , planking; and shoring excepting; such planking, as may,,
be left in by express orders .
Bricks.

All the bricks used shall be of uniform texture hard
burnt entirely through , free frovi lire or other impurities

be used only in making enclosures or as shall be otherwise
