FOR CONSTRUCTION OF A SEWER IN SE' ..R DISTRICT M1MBER t 000 i l This agreement made this 11th day of April , 1907 by i and between the City of Ashland , a municipal corporation , party of the first part , and 3. E. Phipps^, party of the second part , WITNESSrETH THAT WHAREAS THE SAID FIRST PARTY has heretofore deemed ti and adjudged it expedient to construct a sewer>in what is des- ignated as Sewer District Number ; AND TA71REAS the profile and specifications for such sewer have been made by the City tM and filed in the office of the City Recorder , and the same duly approved by the Mayor and common council of the said city ; .UD MIEREAS the common council and the said Mayor did cause notice to be published inviting bids for the construc- tion of the said sewer , a printed copy of such notice for bids being hereto attached and made a part of this contract, together with the profile , plane and specifications therein referred to ; AND WIi,'AS IN PURSUANCE to said call for bids the said second party did make and file with the said City Recorder a j bid for the furnishing of all the material for and the con" struction of the said sewer agreeable to said plans . profile and specifications and form and manner of payment therefor , for the sum of 0 d , (0 V AND .THER& S the said second party was adjudged by the said mayor and corwTion council to be the best and lowest bi9der in the premises and he having filed his certified check as required in said notice , the contract to furnish all the material for and construct the said sewer was duly awarded by r1l Y i S the said common council to the said second party which con. i tract embraces the man-holes and lamp-holes called for in the i said plans and specifications the same as the serer itself and putting in gates at head and lamp-holes on streets ; z _ HOW THEREFORE , the said second party agrees with t e first party that he will construct said sewer , lamp-boles and man-holes ani furnish all the material therefor , timely and in a good and! first class manner , the -sewer to be of the usual vitrified sewer the , and the bricks of good thorough burned quality , and to do all thereof , and furnish all there" of subject to the approval of the City Engineer , or some other suitable person to be appointed for that purpose by the common I' council of the said city , or the property owners along the line of the said Sewer District . Special reference is made herein to the plans , profile and specifications approved by the common council aforesaid and they are deemed and considered a part of this contract . Special reference is also mate to the call for bids here- to attached and it shall be made a part of this contract , and it is expressgreed that all work , material and method and terms of compensation shall conform thereto. IT IS FURTH3AGREED that the saidA party shall proceed, un without any necessary delay to cause to be levied against i the property benefitted by the said sewer , special benefit benefit assessments and proceed to c6lleet the same as rapidly as possible , and in an amount. that shall be amply sufficient to pay the contract price of U (o~ aforesaid. No pipe shall be cohered until the same shall be approved by the Sewer Inspector , but he must examine the same as often as convenient , and either approve or designate any defects therein as soon as practicable and at least_wh&n 4ri~pry fifty feet are laid ' II r. a I~ i1 ii When the work and material on any section shall be approvew ed by the sewer inspector the same shall be covered as soon as i practicable . The work shall be commenced as soon as practicable and shall be completed by the Twentieth day of June , 1907 , and on failure to complete the same the second party agrees to forfeit Five (S) dollars per day to liquidate damages for the failure to complete the same within the said time limit . The second party assumes all responsibilities for damages by the elements and from any unforseen obstructions that may occur , except suits or injunctions which shall suspend any and all damages while in force . The second party shall put up and maintain such barriers and signals as will effectually prevent any accident in co sequence of enbankments , material and excavations, and shall be liable for any and all accidents occasioned by f'tr~ negligence, or that of 14i$)a gents , servants and employees Defective and condemned material must be removed from the line of sever i Care must be taken to protect the water pipes , and in case the same , or any of them are damaged by the second party the second party shall repair the same at his own expense The contractor shall, where practicable , make suitable provisions for the safe and free of passage persons and vehicles by , or over the work when in progress of construc- tion of the sewer and man-holes and lamp-holes and refilling. All exc avat i an shall be done by open out from the surface except when monuments are to be preserved, and shall. be two (2) feet viide , or to be. excavated one (1) foot on each side of the center line of the sewer . The contractor shall at his own cost keep the trenches free from water during; the progress of the work . Excavated material mast be so placed as not to interfere with travel on the street or to incommode occupants of adjoining property . Trenches shall not be opened more than two hundred (200) feet in advance of the laying of the sever. Backfi11ing• Backfilling shall follow close after the construction of the sewer , and in no case be more than one hundred (100) feet in the rear • The filling of the earth around and on top of the sewers shall be done with the ul-most care , and in a manner to obtain the greatest compactness and solidity possible . For that purpose the earth shall be laid and rammed in regular layers not more than one (1) foot thick , up. to the su rfac eCo f the street , or thoroughly soaked with water , as may be directed All work of restoring the surface of the streets and alleys shall be done to the satisfaction of the street commissioner immediately after the sewer is laid . If not so done : 'thin 10 days after the notice , the work may be done by the street coram.issioner a0d the cost thereof shall be paid by the contractor and in default of payment , the cost may be re- I tained by the City of Ashland, out of any money that may be due the contractor under this contract . The price paid for earth and rock excavation shall cover the whole cost of excavating the trenches ane, refilling the same with earth restoring the street and hauling away the surplus material , if any , as well as the whole cost of pumping bailing , planking and shoring , excepting such planking as mays be left in by express orders . B r i c k s. All the bricks used shall be of uniform texture hard, burnt entirely through free from lime or other impurities that will affect them in water , and shall have straight edges and square angles . Broken bricks must not be brought on the ground, and such as are broken afterwards in handling shall be used only in making enclosures or as shall be otherwise specially directed The bricks are to be culled as they are brought on the ground , and ,all bricks of improper quality thrown out and removed from the ground 1 The culling is to be done at the expense of the contractor who shall furnish the inspector vrith the men for this and similar purposes when re- quired The bricks shall be clean and thoroughly wet just be'. fore being used unless otherwise specially directed . Every brick shall be laid with a push joint ; that is , by placing suffieient mortar on the bed and forcing the brick into it in such a manner as to thoroughly fill every joint whether on the bottom , side or end of the brick , with mortar . The joints shall be made as near as possible of uniform thickness , not exceeding three eights of an inch . Cement hfo rtar. Mortar shall be composed of one (1) part Portland cement v mixed in a dry state vrith two (2) parts clean sand , free from loam , the entire quantity of water toi be added , and the vihole mass thoroughly incorporated • Mortar shall only be made in batches for immediate con- sumption , and none used that has begun to set . The cement used will be Atli ft, or some otheb equally as good Portland cement The sand used must be clean , sharp sand , not too fine and free from pebbles. The water used r~u st be clean fresh water . All man-holes and lamp-holes shall be constructed accordiig to plans on file in the City Recorder's office . Pipe. Seiv ers• Each pipe is to be laid on a firm bed and in petfect confon- ~I with the lines and levels given . The bottom of the trench crust be shaped so as to fit the lower half of the pipe as nearly as possible, with places cut at the joints for the sockets to rest in , so that the pipe shall have a uniform bear- ing on the ground from end to end . The pipes shall be jointed by filling the pockets with a mortar of pure cement without sand, with only water enough to give it a proper consistency Great care mast be taken to make the joint throughout the lower three-fourths of the pipe perfectly water tight The upper one--fourth of the joint when so directed shall be left open . The interiot of the pipes shall be carefully cleaned from all dirt cement and superflou s material of every description , and a wad made of a eack filled tirith hay , large enough to fill the pipe and attached to a rod or cord , shall at all times be kept in the pipe and drawn forward. as the work proceeds , cais being taken not to loosen the joints . After the pipes are t!roparly- laid and joined , any space between them and the sides of the excavation must be fille*ith -3- I t3 1 sand , either washed in or well rammed , up to the middle of the pipe .
