HomeMy WebLinkAbout2599 Peachey Rd & Paradise Lane Sewer ImprovementsORDnanCE No. AN ORDINANCE AUTHORIZING AND ORDERING THE IMPROVEMENT OF PEACHEY ROAD AND PARADISE LANE BY CONSTRUCTING SANITARY SEWERS AND AUTHORIZING THE ASSESSMENT OF THE COST OF THE IMPROVEMENTS AGAINST PROPERTY TO BE BENEFITED AND PROVIDING THAT WARRANTS ISSUED FOR THE COST OF THE IMPROVEMENT BE GENERAL OBLIGATIONS OF THE CITY OF ASHLAND. WHEREAS, The Council has declared by Resolution its intention to construct the improvements described in substantial accordance with the plans and specifications and to assess upon each lot or part of lot adjacent to and benefited by the improvement its proportional share of the cost of the improvement as provided by the Charter of the City of Ashland; and WHEREAS, notice of such intention has been duly given and published as provided by the Charter and a public hearing was held and it appears to the Council that such improvements are of material benefit to the city and all property to be assessed will be benefited to the extent of the probable amount of the respective assessments to be levied for the costs; THEREFORE, THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: Section 1. It is ordered that sanitary sewers be constructed on Peachey Road and Paradise Lane in substantial conformance with the plans and specifications adopted and on file in the office of the Director of Public Works and that the cost be assessed upon each lot or portion of lot adjacent to or benefited by such improvement as provided by the Charter of the City of Ashland. Section 2. Warrants for the construction of the improvement shall bear interest at the prevailing rates and shall constitute general obligations of the city of Ashland and the warrants shall be issued pursuant to and on the terms and conditions in ORS 287.502 to 287.510 inclusive. The foregoing ordinance was FIRST READ on the 4th day of September, 1990 and duly PASSED and ADOPTED this 18th day of September, 1990. Nan E.
