Roll call was ordered, the vote being, dyes 6, Clays 0. Carried. } ~ The audit of the City books by the fire of Lybrand Ross Bros. and ~;iontgomery and the terms of their contract was discussed, it appearing that they had apparently violated their contract. Loved by Bergner tYLat the firm of Lybrand, Ross Bros.. and ` l~lontgomery not be paid further on the audit and accounting system and the City attorney be instructed to analyze the contract and advise the Council as to what steps should be taken to complete the terns of the contract and also to make proper adjustment on their invoice. (Refers to failure to use adding machine operator at 45.00 as per eon- tract~ Seconded by Taylez°, carried. The light and water bills, ledger sheets and analysis sheets being found unsatis- factory, same having peen printed from specifications furnished by Lybrand Ross bros. and I~Iontgomery, it was moved. by tirenner that the Mayor write the firr~l that the bills were entirely unsatisfactory and to inquire as t;o what adjustr~ent they proposed to make. He stated that the contract had been violated in seperal instances. Ilo action was taken, it being decided } that the next move ~rJas up to the auditors, Lybrand, Ross Bras., ~~nd ~iontgamery. The City attorney reported an his progress in obtaining options for the rights of ' way for the near road. an ordinance authorizing the issuance of City Irnprcvement Bonds in the matter of lay- ing a s~e~~rer in ghat h~;s been designated as ~evrer District Na. 38 was read. ~~joved by ~~enner that the roles be suspended and the ordinaa~ce be passed to the second re€iding by title ~~7 only. The Talent Irrigr,tian District settlement eras brought up by the City :`attorney and a resolution read proposing that tYie City turn over to the Talent Irrigation District 31 acre feet of water in exchange for payment of accrued charges against the City. The necessity for transfering ~~50.00 to the Surer Bond Redemption Fund to ad just an overdraft was brought up. ~oveu by ~~enner that k~5U.00 be transfered from the Light Fund to .the Sewer ~3ond Redemption Fund as loan. Seconded b~7 Blake. Carried. The City attorney advised the council that the case of the City vs Cates :rind been settled for X300.00, which had been paid by the Bonding Company. ;,:a Selection of G chairman of the couxicil Vacs mentioned. ~~oved by ~~'e~ner that due to his long service an the council that Dr. Blake be elected chairman of the council. Seconded and carried. applewhite spoke on the purch~s e of ~ tractor for the Street ~epGrtrnent but no action was taken. On motion, the council adjourned to meet at the ca 11 of the I~~ayor.
