HomeMy WebLinkAbout3164 Setting Lien Fees by Resolution I ORDINANCE NO. 3164 2 AN ORDINANCE AMENDING AMC 4.12.030 TO ALLOW LIEN FEES TO BE SET BY 3 RESOLUTION. 4 Annotated to show deletions and additions to the Ashland Municipal Code 5 sections being modified. Deletions are bold lam, and additions 6 are bold underlined. 7 WHEREAS, the City of Ashland's fees for lien searches was last established in in 1986 by g Ordinance 2385 9 4 (Ashland Municipal Code 4.12.030); and 10 WHEREAS, the costs of conducting lien searches varies over time particularly with the advent 11 of new technologies; and 12 WHEREAS, fees for lien searches could be modified more easily as costs change if the fees 13 were set by Resolution rather than by Ordinance; and 14 WHEREAS, most other City of Ashland fees are set annually by resolution. 15 16 WHEREAS, the City of Ashland finds it desirable to set the lien search fees by Resolution. 17 18 THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: 19 SECTION 1. Ashland Municipal Code Chapter 4.12.030 of the Ashland Municipal Code is 20 hereby amended to read as follows: 21 4.12.030 Fee - Designated. 22 Before a certificate of a lien search shall be issued, there shall first be paid to the City Recorder the fegowing fees 23 for making the lien search and for preparing the certificates, which fees shall be set by City Council Resolution. 24 .i fee of twenty d o ($10.00) ollars the lien search maybe made within live r if . r6j werkaeg-days 25 27 werUng day of reeeipt~ 28 29 30 ORDINANCE NO. 3164 Pagel of 2 I SECTION 2. Codification. In preparing this ordinance for publication and distribution, the 2 City Recorder shall not alter the sense, meaning, effect, or substance of the ordinance, but within 3 such limitations, may: 4 (a) Renumber sections and parts of sections of the ordinance; 5 (b) Rearrange sections; 6 (c) Change reference numbers to agree with renumbered chapters, sections or other parts; 7 (d) Delete references to repealed sections; 8 (e) Substitute the proper subsection, section, or chapter numbers; 9 (f) Change capitalization and spelling for the purpose of uniformity; 10 (g) Add headings for purposes of grouping like sections together for ease of reference; and 11 (h) Correct manifest clerical, grammatical, or typographical errors. 12 SECTION 3. Severability.
