EASEMENT
For good and valuable consideration, the receipt of which is hereby acknowledged, Richard
C. Cottie and Elizabeth A. Cottie, Trustees of the R.C. Cottie Family Living Trust (u.a.d. August 30,
19951 and Morgan Curtis C0ttle and Susan C0ttle, husband and wife, and Bifiie Jean Phillips,
Trustee of the Phillips Family Trust (u.a.d. June 24, 1988), all collectively hereinafter re~erred to as
the Grantors, do hereby grant, bargain, sell and convey unto the City of Ashland, an Oregon
Municipal Corporation, hereinafter referred to as the GRANTEE, an EASEMENT, the location,
purposes and conditions of which are set forth as follows:
LOCATION: This easement shall be located as described on the attached Exhibit A.
PURPOSE AND USE: This is a non-exclusive easement, granted for the sole purpose of
allowing members of the public to have pedestrian ingress and egress over the same from Herbert
Street to Ashland Street (extended). It is also for the purpose of allowing the City of Ashland an
easement for the installation and maintenance of general utilities and reasonable vehicular access
for the purposes of maintaining the neighborhood park to be located on the premises located South
of said Ashland Street (extended) which has been conveyed by these Grantors to the City of
Ashland for that purpose.
The City of Ashland shall maintain this Easement in a reasonable and prudent manner at its
sole expense. THIS DOCUMENT IS BEING RE-RECORDED TO
CORRECT THE LEGAL DESCRIPTION.

EASEMENT DESCRIPTION
A Pedestrian Access and General Utilities Easement over,
across and through a strip of land variable in width and being
more fully described as follows:
Commencing at a found iron pipe with 3 inch bronze disk
situated at the Southwest corner of the Southeast Quarter of the
Southwest Quarter of Section 9, Township 39 South, Range 1 East of
the Willamette Base and Meridian, Jackson County, Oregon;
THENCE North 89 degrees 47 minutes East along the section
line common to Sections 9 and 16 for a distance of 299.00 feet to
the TRUE POINT OF BEGINNING:
THENCE continuing North 89 degrees 47 minutes East along said
section line for a distance of 5.00 feet;
THENCE leaving said section line, North 00 degrees 17 minutes
West, 5.0 feet Easterly of, when measured normal therefrom, the
Westerly boundary line of that tract of land as set forth in
Document No. 91-32067 of the Official Records of Jackson County,
Oregon, for a distance of 132.00 feet to a point in the Southerly
right of way line of Herbert Street;
THENCE South 89 degrees 47 minutes West along said Southerly
right of way line for a distance of 15.00 feet;
THENCE leaving said Southerly right of way line of Herbert
Street, South 00 degrees 17 minutes East, 10.0 feet Westerly of,
when measured normal therefrom, the Westerly boundary line of that
tract of land as set forth in Document No. 91-32067 of the
Official Records of Jackson County, Oregon, for a distance of
112.00 feet to a point 20.0 feet Northerly of, when measured
normal therefrom, the section line common to Sections 9 and 16,
said Township and Range;
THENCE North 89 degrees 47 minutes East, parallel with and
20.0 feet Northerly of, when measured normal therefrom, said
common section line for a distance of 10.00 feet;
THENCE South 00 degrees 17 minutes East for a distance of
20.00 feet to the true point of beginning.
