HomeMy WebLinkAbout2000-07 Fire Station 1 PropertyRESOLUTION NO. 2000- A RESOLUTION AUTHORIZING THE ACQUISITION OF REAL PROPERTY FOR THE PURPOSE OF EXPANSION AND RENOVATION OF THE CITY'S FIRE STATION NO. 1. THE CITY OF ASHLAND RESOLVES AS FOLLOWS: SECTION 1. The acquisition of certain property or any right or interest in such property for the development of plans and designs and for the construction of the above captioned project is necessary and in the interest of the general public. SECTION 2. It is the judgment of the City of Ashland that it is necessary to acquire the property described in the attached Exhibit A for such purpose. The appraised price of $415,000 for this property is approved, and the council establishes this amount as just compensation for the property. SECTION 3. The city, through the city administrator or his designee, shall attempt to agree with the owners of this property with respect to the compensation to be paid. If the city administrator or designee is unable to agree with the owners, then the city attorney is instructed to commence an action to acquire the property from the owners and any and all persons having or claiming an interest. If it is necessary to commence an action, immediate possession is considered necessary, and the funds described in ORS 35.265 shall be deposited with the clerk of the court. TRACT B: Commencing at the southeast corner of Lot Four (4) in MCCALL'S ADDITION to the City of Ashland, Jackson County, Oregon; thence North along the line between Lots Four (4) and Thirteen (13) of said Addition, 129.0 feet to the northwest corner of said %ot Thirteen (13); thence West 75.0 feet to the true point of beginning; thence South 79.0 feet to the northerly side line of Siskiyou Boulevard at the southwest corner of premises described in deed recorded in Volume 257, page 400 of the Deed Records of Jackson County, Oregon; thence North 8038' East along the westerly line thereof 80.0 feet to an intersection with the north line of tract; thence West 12.0 feet to the true point of beginning. EXCEPTING THEREFROM all that portion lying easterly of that certain boundary line described in Boundary Line Agreement recorded November 30, 1978 as instrument No. 78-27176 of the Official Records of Jackson County, Oregon. ALSO all that portion of that tract described in instrument recorded March 15, 1978 as instrument No. 78-05653 of the Official Records of Jackson County, Oregon lying westerly of that certain boundary line described in Boundary Line Agreement recorded November 30, 1978 as instrument No. 78-27176, said Official Records.
