PERMANENT PEDESTRIAN AND UTILITIES EASEMENT FOR CITY OF ASHLAND
1. Grant of easement. The above named Grantor. grants to the City of Ashland, Oregon,
"Grantee," a perpetual non-exclusive easement in gross to construct, reconstruct, install, use,
operate, inspect, rapair, maintain and remove and replace a public pedestrian easement and
sidewalk across, along and upon the real property described below and further referred to in
this easement agreement as the "easement area"
Grantor also grants to Grantee a perpetual non-exclusive easement in gross to construct,
reconstruct, install, use, operate, inspect, repair, maintain and remove and replace public
utility facilities including but not limited to, lines for electricity, sewer, water, gas and
telecommunications within the easement area.
The easement area is located in Jackson County{ Oregon and is described on the attached
Exhibit A.
2. Use of surface° Grantor shall have the right to yea the easement area for all purposes not
inconsistent with the uses and purposes of the pr3perty, provided that Grantor shall not build
or erect any structure upon the easement area without the pdor written consent of Grantee.
3. Prior Encumbrances. This easement is grantec subject to all prior easements or
encumbrances of record.

PEDESTRIAN ACCESS & PU--3LIC UTILITY EASEMENT
A stdp of land 5.00 feet in width adjacent tel the north right of way line of Maple
Street in the City of Ashland, Jackson County Oregon being more particularly
described as follows:
Beginning at the Northwest comer of the wsst haft of the southeast quarter of
Sectinn 5, Township 39 South, Range I Ee~st of the Willamette Meridian, Jackson
County, Oregon; thence West 173.25 feet; thence south 244 feet, more or less,
to the north right of way line of Maple Street for the True Point of Beginning;
thence east along the North line of Maple Street 80 feet; thence north 5.00 feet;
thence west parallel to the north line of Ma }le Street 80 feet; thence south 5.00
feet to the point of beginning.
