PERMANENT PEDESTRIAN AND UTILITIES EASEMENT FOR CITY OF ASHLAND
1. Grant of easement. The above named GrantorS grant to the City of Ashland, Oregon,
"Grantee," a perpetual non-exclusive easement in gross to construct, reconstruct, install, use,
operate, inspect, repair, maintain and remove and replace a public pedestdan easement and
sidewalk across, along and upon the real property descdbed below and further referred to in
this easement agreement as the "easement area.!'
Grantors also grant Grantee a perpetual non-exclUsive easement in gross to construct,
reconstruct, install, use, operate, inspect~ repair, maintain and remove and replace public
utility facilities including but not limited to, lines for electricity, sewer, water, gas and
telecommunications within the easement area.
The easement area is located in Jackson County, Oregon and is descdbed on the attached
Exhibit A.
2. Use of surface. Grantor shall have the right to t~se the easement area for all purposes not
inconsistent with the uses and purposes of the property, provided that Grantor shall not build
or erect any structure upon the easement area without the prior written consent of Grantee.
3. Prior Encumbrances. This easement is granted subject to all prior easements or
encumbrances of record.

PEDESTRIAN ACCESS & PUBLIC UTILITY EASEMENT
A strip of land, variable in width, adjacent to the North right-of-way line of Maple
Street in the City of Ashland, Jackson Coumty Oregon, being more particularly
described as follows:
Beginning at the Northwest corner of Lot 2,i Block 37 of Coolidges Tract to the
City of Ashland, Jackson County, Oregon; thence South 01° 18' 25" East, 209.74
feet to the a ~" iron pin situated at the Nor!h right-of-way line of said Maple
Street for the True Point of Beginning; thence along said North right-of-way line,
south 89° 46' 50" East, 309.04 feet to a ~ inch iron pin; thence leaving said North
right-of-way line, North 28° 10' 10" West, 13.61 feet; thence North 89046. 50"
West, 75.00 feet; thence South 00° 13' 10" west, 4.00 feet; thence North 89° 46'
50" West; 120.00 feet; thence South 00° 13' 10" West, 4.00 feet; thence North
89° 46' 50" West, 107.69 feet; thence South 01° 18' 25" East, 4.00 feet to the
point of beginning.
