AN ORDINANCE REPEALING CHAPTER 18.55 OF THE ASHLAND MUNICIPAL CODE
RELATING TO HOME OCCUPATION PERMITS: AMENDING SECTION 18.08.230 OF THE
CODE DEFINING "HOME OCCUPATION"; AND ADDING TO THE CODE DEFINITIONS OF
"RESIDENTIAL, OR RESIDENTIAL USE", "COMMERCIAL, OR COM~ERCIAL USE", AND
"INDUSTRIAL, OR INDUSTRIAL USE".
WHEREAS, the standards contained within the definition of "home occupa-
tion" below are sufficient to control and regulate the conduct of such enterprises
and their impact on surrounding persons and property; and
WHEREAS, it is essential to clearly define various categories of use
in order to administer and enforce fairly the provisions of the Code:
NOW, THEREFORE, the People of the City of Ashland do ordain as follows:
SECTION I. The definition of "Home Occupation': in Section 18.08.230 of
the Code is revised to read as follows:
18.08.230 Home Occupation: "Home occupation" means an occupation commonly carried
on within a dwelling by members of the family occupying the dwelling, provided
that the residential character of the building is maintained and the occupation is
conducted in such a manner as not to give.an outward appearance nor outwardly mani-
fest any characteristic of a business in the ordinary meaning of the term except as
permitted in any ordinance regulating signs, nor infringe, in relation to traffic,
noise, or other nuisance, upon the right of neighboring residents to enjoy the
peaceful occupancy of their homes. A home occupation does not involve the retail
saleof a product or service on the premises other than teaching, tutoring, or
counseling involving a traffic impact of not more than one vehicle at one time,
nor m~re than eight persons per day.
SECTION 2. A definition is added to the Code at Section 18.08.092, as
follows:
18.08.092 Commercial, or Commercia Use. Any activity involving the sale of goods
or services for profit.
SECTION 3. A definition is added to the Code at Section 18.08.252, as
follows:
18.08.252 Industrial, or Industria Use. An.activity related to the manufacture,
production, or storage of products to be transported ~!sewhere for sale.
SECTION 4. A definition is added to the Code at Section 18.08.402, as
follows:
18.08.402 Residential, or Residential use. Any activity, as contrasted with com-
mercial and industrial activities, which involves the peaceful private conduct of
pursuits related to the living environment.
SECTION 5. Chapter 18.55 relating to Home Occupation Permits
