A RESOLUTION AUTHORIZING THE ACQUISITION OF PROPERTY FOR
THE PURPOSE OF CONSTRUCTION OF THE CENTRAL ASHLAND
BIKEPATH.
THE CITY OF ASHLAND RESOLVES AS FOLLOWS:
SECTION 1. The acquisition of property for the development of plans and designs
and for the construction of the above captioned project is necessary and in the
interest of the general public.
SECTION 2. It is the judgment of the City of Ashland that it is necessary to acquire
property described as 39-1E-09AA Tax Lot 2,600 in the City of AshTand, Jackson
County, Oregon, for such purpose.
SECTION 3. The city, through the city administrator or his designee, shall attempt to
agree with the owners of these properties with respect to the compensation to be
paid. If the city administrator or designee is unable to agree with the owners of this
property, then the city attorney is instructed to commence an action to acquire the
property from the owners and any and all persons having or claiming an interest. If it
is necessary to commence an action, immediate possession is considered necessary
and the funds described in ORS 35.265 shall be deposited with the clerk of the court.
This resolution was read by title only in accordance with Ashland Municipal Code
