through ,its i~yor and its Recorder, 8ntered into a certain lease and agreement with
Frank J. m ~mder v~hich the latter leased from the City of Ashland, certain pre-
~es c'ommo'~ly ~cao~rn as the Lithia Sprites property belonging to said City of Ashland,
Oregon, and
V~EREAS it is desirable to approve and confirm the a~ion of said City officials
as a matter of record, and
',~Hi~EAS, the said Frank J. Burnham desires to sssign his interest in said lease to
the Gas Ice Corporation, a ~Vashington Corporation, and
',~H~S, it appears the Gas Ice Corporation is a responsible organization and there
is no objection on the part of the City of Ashland to such assigr~ment; ~IOW, THE$.~FOP~,

That the action of the ~,~yo? and the City Recorder of the City of Ashland, Oregon
on ~,~y 22, 1940 in executing and delivering for and on behalf of the City of Ashland,
Oregon, to Franck J. Burnt~m, of a certain lease and agreement under which the City of
Ashland leased to said Frank J. Burnham all that certain real property situated in
Jackson County, Oregon, conm..only known as the Lithia Springs property, be and the same
is in all respects fully ratified, approved and confirmed and the said lease between
the City of Ashland and Frank J. Burnham of l~ay 22, 1940 hereby is acknowledged and
recognized as fully binding upon the City of Ashland, Oregon, a municipal corporation of
the State of Oregon, in accordance vrlth its lawful terms.

The assignment of the within mentioned lease between the City of Ashland, Oregon
and Frank J. Burr~ham dated Nay 22, 1940 by the said Frank J. Burnham to the Gas Ice
Corporation, a Y,'ashington Corporation, hereby is approved and the ~ror and the ?ecorder
o£ the City o£ Ashland, Oregon are hereby authorized~ directed and empo~vered for and on
behalf o£ said City of Ashland, to execute and deliver such supplementary legal
documents as may be necessary to indicate the approval of the City of Ashland of said
assigmment to said Gas Ice Corporation.

That inasmuch as the Gas Ice Corporation, as the assignee of Frank J. Burnham, is
required, under the terms of said lease of D~y 22, 1940, to do and perform certain
things within a limited time from date hereof and it is considered to the best interests
o£ the City of Ashland that said Lithia Springs property be developed and that the
Gas Ice Corporation be in~uediately assured of its right in connection with such pro-
posed developement, it is deemed necessary for th¢~ peaoe, health, safety and general
welfare of the people of the City of Ashland, Oregon that an emergency be and the same
is hereby declared to exist and this Or~nance shall be in full ~orce and ef'fect a~
in~ediately in operation upon its passage by the Comv~on Council and approval by the
M~yor.
The foregoin~ ordinance ~as duly p~ssed under a suspension of the rules at a
regular meeting of the ~ayor and Cormnon Council of the City of Ashland, Oregon, held on
the 4th day of February 1941, the vote being as follows:
