HomeMy WebLinkAbout2000-182 CONT AMND - Berry ArchitectsOctober 3, 2000 City of Ashland, Oregon Architectural Services for Hillah Building Renovations and Additions AMENDMENT TO THE AIA-B141 CONTRACT Between the Owner: The City of Ashland, Oregon 20 East Main Street Ashland, OR 97520 And the Architect: BERRY ARCHITECTS, PC 460 East Second Avenue Eugene, OR 97401 For: Civic Center and City Hall Facilities Note: The Contract is undated, however the signed copy in BERRY's file is stamped November 25, 1998 as date of receipt. PROPOSAL Scope of Architects Basic Services Services shall be as described in the AIA - B141 Contract, referenced above, Article 2, except as follows: 2.1.1 2.2.4 2.2.5 2.3.1 2.3.2 Add civil engineering services to the list of "normal" engineering services included. Change to mad: Based on the space needs assessment dated August 5, 1999 (cover date) and revised on April 7, 2000, and the drawings, including site plan, floor plan, and elevations dated July 14, 2000, the Architect shall continue to prepare for approval by the Owner, Schematic Design Documents consisting of drawings and other documents illustrating the scale and relationship of Project components. Remaining documents include structural, mechanical, electrical, and civil. Architectural documents are complete. Delete paragraph. Add the following. Architectural documents are in progress; documents remaining to be started include structural, mechanical, electrical, and civil. Change to read: The Architect shall submit to the Owner a preliminary estimate of Construction Cost based on current area, volume or other unit costs. Basis of Compensation 11.2.1 Part2 Add the following: For the Hillah Building Renovations and Additions, the fee fbr Basic Services will be the lump sum amount as determined by using a percentage of the estimated construction cost set forth below. The percentage is based on contract Exhibit "E" guidelines. Estimated Construction Cost The project was originally estimated in the presentation of 6/28/99. Scheme "B" using $115/s.f. for new construction; $70/s.f. for remodel, and $3.25/s.f. for site work. A demolition cost of $6.00/s.f. was included in Scheme "A", but inadvertently omitted from Scheme "B". Applying these costs to the areas of the plans dated July 14, 2000 results in the following revised estimate: New Construction Addition - 7,983 s.f. @ 115 = $918,045 Demolition Existing Interior - 6,500 s.fi @ 6 = $ 39,000 Renovation - 6,500 s.f. @ 70 = $455,000 Site Improvements Allowance - 9,000 s.f. @ 3.25 = $ 29,250 Total Revised Estimated Cost for 6/28/99 $1,414,295 Adjustment for Inflation Assume restart of design occurs before November 15, 2000. Time from original date of estimate 6/28/99 to 11/15/00 is approximately 16 V2 months, or 1.375 years. Adjust cost for inflation: Estimated construction cost at restart of design (11/15/00) $1,414,295.00 X 1.375 years @ 3% compounded = $59,485.00. Estimate adjusted for inflation $1,414,295.00 + $59,485.00 = $1,473,780. Fee % for services described in original contract: 10.8% x $1,473,780.00 = Add for Civil Engineering Services (not included in original services) $159,168.00 $7,700.00 Lump Sum Fee for Basic Services $166,868.00 11.2.2 Fee Breakdown: Schematic Design Phase 15 %'1r Design Development Phase 20% J Construction Documents Phase 40% Bidding Phase 5% Construction Administration Phase 20% Total Not To Exceed Lump Sum Fee 35% x 166,868 = 58,404 66,747 8,343 33,374 $166,868 The fee for Basic Services is otherwise fixed unless the scope of the project or the Architect's services are modified and agreed upon previously in writing. Given that the fee is based on the estimated construction value at the restart of design, Owner and Architect agree that the Lump Sum Fee shall he renegotiated if Architect is not notified to proceed prior to December 30, 2000. The basis for the renegotiated fee shall be an adjustment commensurate with any change in the Consumer Price Index (CPI), All Urban Consumers (CPIU), West. (The Schematic and Design Development Phases have been combined because the architectural portion of the Schematic Design has been completed, and the Design Development portion was virtually completed when the project was delayed; whereas other elements of the Schematic Design and Design Development, including Structural, Mechanical Electrical and Civil, have not been completed.) 11.3.2 Additional Services Add: The following Additional Services are a part of the contract as of October 2, 2000. Item Not to Exceed Fee Revised Needs Assessment $ 322.98 Reduced Footprint $1,500.00 · Employee"Breakroom" $ 402.00 Landscape Design $ 3,800.00 Total $ 6,024.98 Note: Although the Owner will coordinate the submittal of the required planning application, Architect agrees that the above services include providing sufficient design drawings for submittal of the required planning application for the project. These drawings have been provided. Minor revisions to the drawings required during the planning process shall also be provided. Major modifications to the plans (i.e., change in design intent or number of stories in the structure) shall be billed on a time and materials basis. The above services also include attendance at up to two (2) public hearings related to the planning process. Total Basic and Additional Services $172,892.98 to date.
