A RESOLUTION ESTABLISHING A FEE FOR CLAIMS FILED
UNDER ASHLAND MUNICIPAL CODE CHAPTER 18.114
(REGULATORY TAKINGS UNDER MEASURE 7-2000)
Recital:
Ashland Municipal Code Chapter 18.114 was adopted in response to the 2000
amendment to Article 1, Section 18 of the Oregon Constitution passed by the voters at
the November 2000 election. The code chapter provides a procedure to process claims
submitted under the authority of this constitutional amendment and establishes a fee for
the submission of such claims. This resolution sets the fee authorized by AMC
§ 18.114.030.C.
THE CITY OF ASHLAND RESOLVES AS FOLLOWS:
SECTION 1. The fee to be paid in advance of acceptance of a notice of claim as
provided in AMC 18.114.030.C is $1,500. This fee is charged to cover the costs of a
completeness review and application processing for claims filed pursuant to AMC
Chapter 18.114. The application fee shall be refunded if the city or an appellate body
determines that just compensation should be paid.
This resolution was read by title only in accordance with Ashland Municipal Code
