PERMANENT PUBLIC PEDESTRIAN EASEMENT FOR CITY OF ASHLAND
1. Grant of easement. The above named Grantors grant to the City of Ashland, Oregon,
"Grantee," a perpetual non-exclusive easement in gross to use, operate, inspect, repair,
maintain and remove and replace a public pedestrian easement across, along and upon
the real property described below and further referred to in this easement agreement as
the "easement area."
The easement shall remain in effect in perpetuity as long as the signage for trail access
and limitations on use remains in place and is adequately maintained.
The easement shall remain in effect in perpetuity as long as the use of the public open
space and trail area remains in a non-active park use.
The easement area is located in Jackson County, Oregon and is described on the
attached Exhibit A.
2. Use of surface. Grantor shall have the right to use the easement area for all purposes
not inconsistent with the uses and purposes of the property, provided that Grantor shall
not build or erect any structure upon the easement area without the prior written consent
of Grantee.
3. Indemnification. To the extent permitted by the Oregon Constitution and the City of
Ashland charter, the Grantee shall, within the limits of the Oregon Tort Claims Act,
indemnify Grantors against any liability for damage to life or property arising from the
Grantee's or the public's use of this easement. Grantee shall not be required to
indemnify Grantors for any such liability arising out of the wrongful acts of the Grantors or
the employees or agents of the Grantors.
4. Prior Encumbrances. This easement is granted subject to all prior easements or
encumbrances of record.

EXHIBITA
PEDESTRIAN ACCESS EASEMENT
The westerly 10.00 feet of Lot 4 of Scenic Heights Subdivision, a planned
community in the City of Ashland, Jackson County, Oregon as recorded in volume 21 of
Plats on Page 3 of the Records of Jackson County, Oregon. The westerly boundary of
the easement being common to the westerly boundary of said Lot 4 and containing
1,763 square feet more or less.
